Liow declines Chua's offer tells him to quit

KUALA LUMPUR, Nov 12 — Datuk Seri Liow Tiong Lai declined Datuk Seri Dr Chua Soi Lek’s “offer” to step aside and let him take over as MCA deputy president because “it is not his to give”.

The two men involved in a tussle over the MCA deputy presidency continued to trade barbs this week with Liow maintaining today that Dr Chua should heed the decision of a recent EGM and step down.

Liow also wrote to the Registrar of Societies (RoS) on Monday to explain his side of the story but has yet to receive a reply.

Yesterday, Dr Chua, who was declared the rightful deputy by the RoS, accused Liow of "flip flopping" over whether he wanted to be president or deputy president and offered to step aside if Liow says he wants to be deputy.

Liow today declined to take up Dr Chua's offer and said that the deputy president's post did not belong to an individual but belonged to the party and so it was not Dr Chua's to give.

"The position belongs to a party and not any individual. Dr Chua should respect the results of the Oct 10 EGM and surrender the deputy president post unconditionally and go for fresh elections," said Liow at a press conference before briefing Johor delegates on an upcoming EGM.

The Kuas in the pictures above reflect their state of zombie like thinking , when instructed they will hip hop , no further action as what the police will say . They will have a master controller , like a remote controller who will dictate what , when , how and they will respond accordingly .

    The CONSTITUTION of the party is supreme. Every member irrespective of his position in the party including all the principal office bearers ought to uphold the constitution. In the event of doubt with regard to any dispute, the directives or interpretation pertaining to the Articles or Rules made by ROS have to be respected and executed. The constitution of the party was drafted, accepted and endorsed by the party through its AGM/EGM was submitted to the ROS and subsequently approved by it for the party to function legally. Any articles or rules deemed no longer applicable should be amended. For any resolution passed during AGM/EGM to be applicable or carried out legally it must conform with the constitution of the party.

    Thus during the 1st EGM, the outcome of the Resolution 1 did not vote out the President as Article 35 is crystal clear. Datuk Seri Ong Tee Keat is still constitutionally the President of the Party. I beg to differ from the view of Datuk Seri OKC the ex secretary general MCA who said that Datuk Seri OTK ceased to be President after the EGM.
    I am very disappointed that he should be so naïve and unable to interpret such a simple and straight forward Article 35 of the constitution. Be sincere and conscientious when dealing with such a serious matter.

    In Datuk Seri CLS’s case Datuk Seri Ong Ka Chuan tried to divert the blame to both CSL and OTK which is very irresponsible. As Datuk Seri CSL’s had clarified, he had already advised Datuk Sri LTL against the ploy to be appointed the Deputy President as he had written to the ROS for clarification pertaining to his post. Unfortunately, LTL and his cohorts were too impatient. At the same time, the ex legal bureau chairman also has much to be blamed as he had wrongly advised LTL regarding the matter. ROS is the governing body to all the legally registered societies in Malaysia including MCA, thus its directives or interpretation of the constitution are binding. Consequently, in the case of DS CSL, ROS stated that the Deputy President post has not been vacant after the 1st EGM thus again Datuk Seri Chua So Lek is the undisputed Deputy President. of the party.

    I hope Datuk Seri Ong Ka Chuan would advise LTL and cohorts that being the minority they should work with the President who enjoys the majority support of the CCMs and not trying to champion for the indiscipline lost souls. The GUP was tabled by the President, deliberated at the CC meeting, accepted and sanctioned by at least 30 of the 43 CCMs. LTL and his cohorts being the principal office bearers are constitutionally bound to adopt and implement GUP. This is DEMOCRACY which he has been saying to uphold.

    The party will not face deregistration if the party functions according to the constitution and always abide by the interpretation and directives of ROS. I have been dealing with ROS for decades being actively involved in NGOs and I am confident that by informing and getting clarification from ROS and abide by it will not land MCA in hot soup.

    Since LTL doesn't care about LTL, why should MCA cares about LTL?

    1. so that attention can be drawn away from MCA and OTK.
    2. LTL and gangs without WKS or buzy WKS will have less noise and stupid strategy.
    3. show all malaysians and the world that WKS is the one who planned and started all this mess.
    4. and of cos,dirty and evil deeds should be applied to this group of corrupted evil snakes, WKS,CMF,LTL,OKT,OKC,LLS,TKS,ETCS,,,.

    What Ka Chuan is trying to THREATEN us is that he said "the Court" may declare MCA illegal....

    This means LTL gang may go to court for a declaration...after EGM2....

    I maintain that we let them have their EGM2 BUT we must make sure that it gets less than 1/3 of the delegates, so that it is aborted.

    Once it is aborted, it DOES NOT matter whether EGM2 is constitutional or unconstitutional....The court won't entertain their application...because they are defeated in the EGM2....

  16. Why the other side seems not to understand that in any organisation there is and should be rules/laws to govern the actions of ....Why resort to lawlessness as a means of settling problems. From the start leaders even from the highest do not understand the egm results has to be read together with the constitution...They talked about morally then slided down to legal and political and what now the arguments by some even among lawyers who are bias seemed to talk about the moral issue per se. What is really wrong with these people/leaders. Certainly the issue plaguing is not about purely one of egm but guess that there must be movements behind the scene to agitate matters to achieve their own agendas. It is quite hard to believe friends can suddenly become enemies even in a political situation. Guess whatever agendas must have planted from the start. That's why the evil side seems to take over and the flip flop attitudes and the wavering stance seem interwined and hard to unfurl. Fighting for a losing cause can be ...Hope the .....in egm not rigged....Looks like it going to happen ...it is hard to overcome with good ...like offering the deputy post to... Look set for further lawlessness and the end further chaos unless something is done. Bias reporting in the media must stop... Foul play must be arrested ...People's mind must be educated and not bought...This is the mess... a dangerous mess. Beware, in particular those who are liberal and demoncratic.     Because they have absolutely NO legal ground to stand on !

    1. They have 12 CCs, not even enough for the 1/3rd requirement to call for an egm

    2. Thus, the 11/28 egm will be by default, illegal

    3. They have no right to call CSL to resign (no, I don't really like CSL, but legality is legality, it's not something personal)

    4. Do you know why they are targetting CSL? Because they can't fight CSL and OTK both at the same time, so they are opting for the "Divide and Conquer" technique.

    5. Their only aim is to topple OTK, so that the PKFZ scandal will forever be a secret.

    6. Failing that, they want to destroy MCA so that OTK wouldn't be a president no more.

    7. Which means, they want to crush MCA (by suing MCA).

    8. LTL and his FGZ gang have NO LOVE for MCA anyway.

    9. So why MCA still tolerate these people?

    10. I am no lawyer, but in any organization that I know, there is always a clause somewhere that says that if a members want to do harm to the organization, he will be forever banned from it.

    11. Is there such clause in the MCA charter? If so, use it to kick out all those FGZs.

    12. If not, it is time to amend your constitution so that in the future, NO ONE CAN DO WHAT THE FGZs are doing !

They have are using jungle laws....but if you observe carefully monkeys in the jungle to a certain extend also observe certain ethics which sad to say the lost souls do not practise. Like ...... stabbing at the back of their boss. Or saying the president tak boleh pakai already.

    Rule 9 : Subject to Article 14 hereof no person may be accepted nor having been accepted ramain as a member unless:

    Article 9.3 : he agrees and undertakes to observe all the rules, regulations, bye-laws and conditions applicable from time to time to such membership, to abide by this Consittution and to adhere to the programmes, principles and policies of the Party.

  19. The party election is falled on 2011, but now some body wants to start the party campaign early. OKC wants to be minister again and attacks CSL , his target for 2nd post is logic , Brutus Liow aims 1st post as he has declined CSL offer , Brutus Wee senior VP post but this not is his target.CMF - do not know how to Fun Black & White - useless wanita chief . These Brutus & Snake gang want to overtake GUP which to be review after6 months. So 2/3 CC , delegates , divisions should be ready to work hard earlier again. MCA - Many Chinese Angry now.

  25. You are NOT wrong . The party constitution was amended two years ago when Members from the Bukit Mertajam brought the Party to court over the Phantom members issue and the setting up of Phantom Branches by the Division Chairman align to the Ong KT faction .

    (1) Actually any MCA member can take a matter to courtlah...provided he has satisfied certain conditions.

    (2) Let's examine Article 175 of the MCA Constitution:

    "Notwithstanding any provision to the contrary herein this
    Constitution contained no member shall take any Party
    matters to a court of law until he has exhausted all
    possible avenues or remedies provided by the provisions
    of this Constitution."

    (3) The main condition is this: He has to exhaust "all possible avenues or remedies" provided by the Constitution. THIS IS WHAT THE LTL & CO TRYING TO DO NOW SO THAT THEY CAN GO TO COURT....

    (4) Every law student & lawyer know that a client has unfettered legal rights to take any matter to courts. So the authorities/parties/NGOs may attempt to prevent court cases by using the exclusion clauses such as "the decision is final & conclusive; no court action is allowed" etc..

    (5) We come across these causes in the Societies Act 1966;Umno party constitution....

    (6) To illustrate my point, in the 80's Tan Koon Swan's faction managed to bring their grievances to the High Court (YA Harun Hashim heard the case)and Radzi Sheikh Ahmad (on behalf of Tengku Razaleigh)sought court action until the whole Umno was declared an illegal organisation....

    (7) Every lawyer is also able to advise his/her client that court action is always available on the ground of "natural justice"....

    (8) Of course, we must admit that in Malaysia, the courts are SLOW to interfere in political disputes, for the judges (except perhaps
    YA Mohd Arif Mohd Yusof who was a PAS member/candidate for Kota Damansara in 2004)
    are not familiar with complex politicking....

    (9) Further, among us Chinese, we have "HOME RULES" (KA-FATT/JIA FA) to settle every dispute. So all disputes in MCA need to be resolved internally. Only FGZs (traitors/running dogs) forget about this established system!

    Is your MCA Constitution the latest edition?
    The constitution has been amended and the latest on approved by the ROS is dated 6th December 2007.

    Article 174 reads:
    In case of any dispute as to the interpretation, construction, rendering or meaning of all or any of the Articles of this Constitution or of any Standing Rules and Orders,or of any rules, regulations and by-laws made thereunder, or of any word or words contained in any such Articles, Standing Rules an Orders, rules, regulations and by-laws, the interpretation, construction, rendering or meaning determined and fixed by the Central Committee shall be final and conclusive and not subject to question by or in any court of law.

    Article 175 reads:
    Any member who commences, institutes and prosecutes any action or proceedings against the Party in a court of law in respect of the decision of the Party or any person authorized by the party or by this Constitution or rules or regulations made thereunder; on the interpretation of this Constitution, rules or regulations or any matter relating to the affairs of the Party without first exhausting all avenues or remedies provided by the provisions of this Constitution shall immediatley cease to become a member of the Party and shall be deemed to have immediately ceased to hold any office or positions to which he / she is elected and / or appointed to.

    The articles above should be able to clear the issue.

He speaks with forked tongue.The cockcroach has finally come out of its hole to scavenge whatever is leftover.The party would have been declared illegal during his tenure as SG if all the illegal decisions made by him had been made public.After the delineation exercise,2 branches in Batu Kawan constituency were put in Bagan constituency because the chairmen of these branches were his brother's supporters.Objections by Batu Kawan members made to him were in vain, even though geographically the 2 branches which are in Prai are under the Batu Kawan parliamentary constituency. This is an example of how high-handed he was as a SG.He did things just to suit himself and his brother not the party.I thought after the election that was the last I would hear of him, but then a cockcroach is a scavenger.   36. Please be informed that Taman Chai Leng has 2 branches, Chai Leng Park Branch and Taman Kurau Branch. OKC put Prai and Chai Leng Park branches in Bagan because the division chairman told him that the members in those branches were OKT supporters and maybe S.Velu had told him that the delineation boundary i.e. the Prai river would be turned into a road and the Prai main road would be dug up and turned into Prai River. antikachuak

    The other " great thing " he has done as president to consolidate his position as president is the injection and creation of Phantom Members and Phantom Branches within all the Divisions and having Phantom Central Delegates meaning CDs representing zero members and fictitious branches . Branches that are created with fictitious names all plugged in from the illegal use of photostated ics from direct selling companies members . And who is the one who made this happen in collaboration with the mastermind ? his brother , of course who is the Secretary General of the Party , who also controls membership as well as the headquarters administration .

  40. I hv noted a phantom branch was formed in my division and have duly informed the ex-GS and what I recalled from his saying that " I knew, I will remedy It ". The time while comes for the election, not even the phantom branch which i mentioned yet to remedy, even more of the phantom branches set up. If the time has brought this matter to court , MCA could be de-registered because all-level party officers was elected. This why today he say MCA has a danger to be de-registered, I believe what he say has reason because he is the one who created all the phantom branches.

    The BM Division under the leadership of Lau Chiek Tuan set up 10 Phantom Branches prior to the Party election sometime in 2004 to be in time for the 2005 party elections and until now is still there . That was the reason the BM division people brought the party to court resulting in the constitution amendment and approved by ROS in 2007 . Subsequently they all left en bloc . Today the dep speaker of Penang is one of the ex mca members who left and join PKR . All because of Ka Chuan .

    We also lost Perak because of Ka Chuan . Immediately after the 308 , BN had 28 ADUNs compared to PR who had 31 ADUNs . If BN had won additional 2 , the score will be 30 for BN and 29 for PR . BN would have formed the state govt without all those mess in Perak today with a thin majority of one .

    Why put the blame on Ka Chuan ?
    He was or is ? the state Chairman of Perak at that time . MCA contested 16 state seats and only won one , lost 15 . Why we lost ? because he changed the candidates at the last minute when the proposed were all removed and replaced with his machai(s) with the approval of his brother . The divisions revolted and refuse to campaign and voted for the opposition to make sure they lose the election .
    However we won three Parliamentary seats in Perak , the brother put OKC ina safe seat in Tanjong Malim which is traditionally an MCA safe seat . We won the other two Lumut (Kong CH ) and Batu Gajah ( Lee Chee Leong )
    Normally we would win at least two state seats for every parliamentary seats as there are three state seats for every parliament seat . On most occasions , people would vote BN for state and opposition for parliament as they want a voice in parliament and development for state ,this was not the case .

    It is very clear the people REJECTED OKC's change of candidates and its also very CLEAR they REJECTED the ONG Brothers Sdn Bhd .

    They voted Parliament for MCA and voted OUT OKC's choice candidates .
