The Registrar of Societies (ROS) made a “purely legal” ruling based on the MCA constitution in reinstating Datuk Seri Dr Chua Soi Lek as the party deputy president.

The same provision used by the registrar also kept Datuk Seri Ong Tee Keat as president, Prime Minister Datuk Seri Najib Tun Razak said.

“The MCA constitution stated that it required two-third majority to remove anyone in MCA, whether elected or appointed.

“Based on this, ROS interpreted that Dr Chua is the deputy president. The same provision also keeps Datuk Seri Ong Tee Keat as president of MCA.

“The principle is consistent (applicable to both) and not conflicting,’’ Najib told reporters at Parliament when asked to comment on the latest development in the party.

He added that the most important task for the MCA leaders now was to go to the ground and make sure the Chinese community “buy into” the solution for the leadership crisis.

On the position of Deputy Finance Minister Datuk Chor Chee Heung, one of the four MCA central committee members removed on Tuesday, Najib said “leave the government position to the Prime Minister.”

Home Minister Datuk Seri Hishammuddin Tun Hussein denied speculation that Najib and himself had a hand in the ROS decision.

“I personally oversaw the situation. There is no possibility the Prime Minister ordered the ROS to do this.

“Do not connect the Prime Minister to this matter,” he told reporters at the Parliament lobby yesterday.

He added the decision made by ROS was based on the Societies Act 1966 and the MCA constitution.

The ministry and the ROS would stand by the decision, he added.

Hishammuddin said parties aggrieved by the decision had a right to bring the matter to court or other appropriate channels of appeal.

In a separate function, Deputy Prime Minister Tan Sri Muhyiddin Yassin said Barisan Nasional would not hold any special meeting over this issue.

“The MCA leaders including Ong Tee Keat, Dr Chua Soi Lek, Liow Tiong Lai, Youth chief (Datuk Dr Wee Ka Siong) and Wanita chief (Datin Paduka Chew Mei Fun) need to to calm down as I am sure all the leaders can find a solution,” he told reporters after opening the Asian Pacific Aquaculture 2009 and the Malaysian International Seafood Exposition 2009.

Muhyiddin said Dr Chua had come to see him to explain about his position yesterday morning.

“If Liow wants to, it is his right to challenge (the ROS decision). He was previously the vice-president but then he was elected as deputy president by the central committee,” he said.

One party, he added, could not have two deputies.

“I hope this issue can be solved so that there is one deputy, whoever that may be.

“But what was decided by the ROS was based on the party constitution,” he said.

  3. Liow would twist the PM's words. He did that before and he would do that again. He would thank the PM for his advise. There is the ROS solution that is acceptable legally. But the solution must also be acceptable politically as expressed by the PM earlier.

    This celaka person would turn and twist words to his benefits. As long as he dont get to be president, he will not stop.

    Wanita MCA chief Datin Paduka Chew Mei Fun said: “Any sort of unity plan is welcome but more importantly the party should uphold the democracy that we believe in. This should be given more importance.

    “The outcome of the EGM results were definitely neglected. Where is democracy here?” she asked.

    KUALA LUMPUR, Nov 13 — The MCA leadership soap opera took another turn today with the group calling itself the “third force” reversing its earlier position to now support the leadership of party president Datuk Seri Ong Tee Keat and deputy Datuk Seri Dr Chua Soi Lek.

    Third force spokesman Datuk Tan Kah Choun said the group supported any initiative to unite the party such as Ong's "Greater Unity Plan" and is against a proposed Nov 28 extraordinary general meeting (EGM) calling for fresh elections pushed by Datuk Seri Liow Tiong Lai's allies.

    He claimed that the party vice-president and his supporters in the central committee were aligned to past MCA president and deputy president Tan Sri Ong Ka Ting and Tan Sri Chan Kong Choy.

    Tan also alleged that those who called for the latest EGM had a "hidden agenda" to "safeguard their positions and interest."

    "The MCA leaders know how to play on sentiments. They don't think of the party. The loser will be MCA," Tan told a press conference here today.

    Liow did not immediately respond to a request for a response to Tan's claims.

    Tan, who is a central delegate, however stopped short of calling for a boycott of the Nov 28 EGM, saying he has not decided yet to attend the meeting.

    The third force had previously urged MCA central delegates to reject both Ong and Chua at the Oct 10 EGM and the results appeared to show that the third force had some influence when two of the three resolutions went against the two men.

    Tan also asserted that party delegates were "fed up" with the 2nd EGM as the party’s annual general meeting (AGM) was just a week later on Dec 5.

    He also claimed that of the 16 central committee members who requisitioned for the EGM, three had switched support to the unity plan.

    "Fresh elections are required only if two-thirds of the central committee resign. Even if the resolutions of the EGM are passed, the central committee members are still legal and do not have to resign," said Tan, who is chairman of the Rasa Jaya branch in Selangor.

    He urged Barisan Nasional chairman Datuk Seri Najib Razak to consult 11 MCA party veterans especially Tun Dr Ling Liong Sik and Tan Sri Michael Chen.

    "Tun Ling was party president for 17 years so he should know how to deal with this while Michael had the most grassroots support in past MCA crises," said Tan.

    He was coy, however, on whether Ling was behind the third force, only saying that there were four MCA veterans involved.

    Other veterans named by Tan as men Najib should consult were Tun Dr Lim Chong Eu, Tan Sri Lee San Choon, Datuk Dr Neo Yee Pan, Datuk Mak Hon Kam, Tan Koon Swan, Tan Sri Lee Kim Sai, Tan Sri Lim Ah Lek, Ka Ting and Kong Choy.

    He said as a last resort, the prime minister should consult Tun Dr Mahathir Mohamad as the latter had "solved three previous MCA crises."

    "It should not be seen as Umno interfering with MCA," said Tan. "MCA does not have any resources to split and Barisan Nasional does not have time to wait."

    TECHNICALLY, the requisition is considered VALID when accepted by Sec-Gen Wong FM/Party HQ on that day, before 4/16 were terminated as CC members on 4 Nov.

    But Liow's gang disagreed to amend the EGM requisition as suggested by Sec-Gen.They knew that once the requisition is amended,it would be void as they didn't have 1/3 CC members behind them!

  16. The number of requisitionists is important as the day they submit the requisition is not the day they execute the said requisition to have the EGM. 16 requisitionists submitted the requisition. The request was rejected because the resolutions and the reasons given are unconstitutional. They should have amended their requisition and resubmit the requisition. Thus the date when the 3 requisitionists sent out the notice which should be deemed to have executed the requisition. The number then was 12 as 4 appointed requisitionists had been sacked by then. Thus the requirement of Article 30.2 is not met which has rendered the 2nd EGM unconstitutional.

    Yesterday, around 500 people attended LTL's pre-EGM report meeting.

    apparantly this 500 people, are not absolutely MCA members but just merely local tourist (mainly from Pahang/Johor)in a TWO DAYS ONE NIGHT KL(GENTING) TOUR.

    So very the no umph la this meeting. No one attend need to pay money to tour agent to make the tourist "pass by" MCA to show that LTL got lotsa support.

    So next time subscribe tour in KL, make sure you sue them if they bring you to MCA building for no apparent reason ok?

    Ex-KTM chief defends purchase of used trains

    KUALA LUMPUR, Nov 13 – Former Keretapi Tanah Melayu managing director Datuk Radzak Abdul Malek has defended the purchase of used Diesel Multiple Units (DMUs) from Spain, saying it was to overcome a shortage of commuter trains under an economic stimulus programme.

    Radzak also disclosed that the rail company paid less than other countries for the used DMUs.

    “During my tenure as KTMB MD, one of my main priorities was to resolve the problem of having insufficient trains faced by the public who use the KTMB Komuter services, especially in the Klang Valley,” said Radzak, who was KTMB managing director until last July.

    “With public complaints mounting, it was a problem that needed to be resolved fast,” he said in a statement issued today.

    He added that buying the used diesel trains was the fastest way for KTM to solve its problem.

    “We bought used DMUs and not Electric Multiple Units (EMUs) because there were no used EMUs readily available anywhere in the world then.

    “Purchasing new sets would require a waiting time of between two-and-a-half to three years – a delay KTMB could ill afford as it aspired to provide the best services to the public, especially those using its Komuter services,” Radzak said.

    He also dismissed the reports that the purchase was against the KTMB board’s decision.

    “Besides, at that time, KTMB had very little choice but to urgently overcome capacity problems following a surge in demand for its Komuter services,” he added.

    Radzak also reiterated Transport Ministry’s stand, declared in a recent statement, that it had bought the trains at a reasonable price.

    “The Ministry of Transport had in a statement on Nov 11, 2009, clarified that each set of the DMU cost Euro 1.492 million per set, cheaper than the units bought by Costa Rica, at Euro 2 million per set,” said Radzak.

    "Claims that the sets bought by KTMB were more expensive is grossly untrue,” he added, stressing the purchase was made under the economic stimulus programme to get Malaysia out of the economic recession.

    Early this week, Umno MPs had questioned the KTMB’s purchase in Parliament.

    Sri Gading MP Datuk Mohamad Aziz claimed that the railway board did not authorise the purchase of “out of commission” diesel trains for the project but Transport Minister Datuk Seri Ong Tee Keat had used his “minister’s power” to approve the purchase.

    Mohamad had earlier asked Ong to quit the Cabinet over his non-performance as a minister. Ong is currently embroiled in a leadership crisis within MCA which he attributed to his tough stance over the Port Klang Free Zone (PKFZ) scandal.

    The main contractor for the PKFZ is Kuala Dimensi Sdn Bhd which is headed by Bintulu MP Datuk Tiong King Sing, who is also chairman of the Barisan Nasional Back Benchers Club, of which Mohamad is a member.

    (1)I suggest that we need not go so far to 'kacau' Uncle Leong by lodging complaints to Bar Council and/or Police Station.

    (2) He is a politician. So we 'kill' him POLITICALLY is good enough.

    (3) Talking about Bar Council, the disciplinary process there is very long and winding, and the committee is overwhelmed with complaints....By the time the Committee is ready to hear our complaint (if any), the MCA crisis is over already man!

    (4) It is wise and effective if we were to focus on several core issues in this blog, especially in the dissemination of vital info to the readers --just to expose these FGZs true colour....

    (5) Uncle had received two(2) blows already. A final blow will surely disappear him from the political scene in Malaysialah.

    Eastern Daily report:

    Around 500 MCA grassroot members went to KL, in 10 buses, to attend a seminar by the "Committee to return dignity to party".

    As it turns out, these 500 MCA grassroot members were going to Genting, on a 2 day 1 night tour.

    Many of them have no idea of the "2nd EGM" that is to be held on the 28th of Nov.

    According to the organizer of the seminar, there was a strong showing of 500 attendants. However, according to those who were there, of the "500" people attended the seminar, a lot of them are little girls and little boys.

    A lot of those who were in the 2 day 1 night trip were going as a family. Many of those who attended the seminar admitted that the "seminar" was only part of the itinerary of the Genting Highland tour.

    When asked if they support the "2nd EGM" that is to be held on the 28th of November, a lot of them were saying that they have no idea what that "2nd EGM" is all about.

    And they were also reluctant to tell the reporters from which branch (of MCA) they came from.

    Many in the group also says that their 2 days 1 night tour include a trip to Putrajaya, Genting Highland and KL.

    Most of the attendees were from Pontian and Tanjung Piai (spelling?) area.

    The tour was organized by a fella with the name of "Huang Ri Shen".

    2. What I am trying to stress is this: We should concentrate on CORE ISSUES and "SENIOR SNAKES".

    3. By aiming our ammunitions at Uncle Leong, we may lose sight of the bigger issues. By 'screwing' him ( Uncle Leong) again and again will certainly make him look so important --whereas, in reality, Uncle Leong is only a 'cari makan' lawyer, a small man....

    4. We don't have much time and energies. This is what DPM TS Muhyiddin said to day:

    "The deputy prime minister explained that intervention is an option only if a consensus for it could be reached by the party but stressed that BN has had a role in previous MCA crises.

    “I am of the opinion that there must be a solution to this problem, which is becoming more complex, so maybe if they find it hard to solve the problem among themselves, then they might need to find a middleman...."
