Ling thanks Dr M, wants Cabinet's PKFZ minutes declassified

All Roads in Malaysia leads to a paradise called Kerala

Mahathir and Ling
Malaysia Chronicle

UPDATED In an attempt to best defend himself against cheating charges, former Transport minister Ling Liong Sik has asked for Cabinet papers including the minutes of meetings related to the Port Klang Free Zone to be declassified.

His lawyers have also sought to transfer the case from the Putrajaya sessions court to the Kuala Lumpur High Court.

“Ling needs the Cabinet papers to clear his name. If the Cabinet minutes are declassified, it would make his job much easier,” PKR strategic director Tian Chua told Malaysia Chronicle.

"But the chances of that happening may not be that high. However, he can still verbally expose all those who were also pulling the strings behind the scenes and let the government explain."

Thank you, Dr M

Meanwhile, Ling told reporters he was thankful to former premier Mahathir Mohamad who has said he would testify for the former MCA president if asked to.
Ling being helped down the stairs by his son
"Thank you very much. That is very generous! He was chairing the Cabinet meeting then. I'm being charged with cheating the whole Cabinet, including him. So all those witnesses are very important. If they were cheated, then I'm guilty. If they were not cheated, then there is a trial," ," Ling told reporters on Friday.

He also declined to comment when asked by reporters if he could have been a scapegoats for other government leaders in the PKFZ debacle.

On July 30, in a move that stunned the nation especially the Chinese community, Ling was arrested and charged under Section 418 of the Penal Code for misleading the Cabinet between Sept 25 and Nov 6, 2002, into agreeing to buy 999.5 acres of land on Pulau Indah for the PKFZ project at a price of RM25psf on a deferred payment method for a 15-year period, at a 7.5 interest rate.

According to the charge sheets, Ling did not tell the Cabinet the Finance Ministry had already valued the land at RM25psf inclusive of compounded interest, which would have saved the government a whopping RM720 million.

The charge carries a maximum seven years’ jail or a fine, or both, upon conviction. Ling also faces an alternative charge, under Section 417, of cheating the government by misleading the Cabinet on the land acquisition for the same project. Under the alternative charge, he is liable to a jail term of up to five years or a fine, or both, upon conviction.

The 67-year old Ling is one of the most prominent politicians to be nabbed in recent years. He pleaded not guilty and was released on bail of RM1 million. The next mention date has been fixed on November 30.

Who is next?

The PKFZ is the Malaysian government's biggest port investment and was mooted during Mahathir's administration. It is also the biggest flop in a long list of failed or ailing government-projects that have been slammed by anti-corruption activists through the years.

One of the worst financial debacles
PKFZ began in the early 2000s at an original budget of RM1.9 billion, but this has ballooned multiple folds due to glaring mismanagement and alleged graft. Its auditor has warned that if its debt is not revamped, interest charges alone could boost the final bill to RM12.5billion.

An investigation into the financial debacle has shown that the project's massive cost overruns were due to high-level corruption. PKFZ overseer PKA blames Kuala Dimensi for the problems and is suing it for RM1.4 biliion. Kuala Dimensi is controlled by Bintulu MP Tiong King Sing, whom many in the political circles regard as being a "money bag" for Umno.

Meanwhile, Ling's lawyer Wong Kian Kheong told the court the defense needed the Cabinet papers and minutes to build their case. Currently, the documents are guarded under the Official Secrets Act 1972.

He also asked for permission to interview witnesses in the presence of the Investigating Officer.

"We need to declassify the documents in order to prepare the necessary defence arguments. I am applying for an early mention date as my client is a retired minister. He has also been a long-serving public servant," Wong told a packed court room.

There is widespread speculation that more arrests will follow Ling's but so far no 'big fish' has been hauled in by Prime Minister Najib Razak's administration.

However, reliable sources told Malaysia Chronicle that after Hari Raya, at least one more prominent former leader will be arrested - this time from Najib's own Umno party.

Ong cries double standards in PKFZ bond payment

July 30, 2010
Ong said the government’s insistence in paying KDSB was “foolhardy”. — file pic

KUALA LUMPUR, July 30 — Datuk Seri Ong Tee Keat questioned today the government’s decision to pay bondholders of the turn-key contractor in the Port Klang Free Zone (PKFZ) despite an ongoing legal dispute, when it had defaulted on the bonds of another government-backed port project.

The former transport minister was commenting on the decision of the transport ministry to direct the Port Klang Authority (PKA) to meet its payment obligations towards four special purpose vehicles (SPVs) established by PKFZ turn-key contractor, Kuala Dimensi Sdn Bhd (KDSB), to raise funds from the bond market.

The PKA had been under pressure to pay the KDSB bondholders partly over fears that a default would negatively affect the country’s fiscal ratings.

Ong pointed out, however, that the reported default on the RM240 million bond issued by Malaysian International Tuna Port Sdn Bhd (MITP) did not create a ripple in the market.

MITP, 40 per cent owned by the Fisheries Development Authority of Malaysia, defaulted on payments to bondholders last November. The bonds of both PKFZ and MITP were backed by government support letters.

“The fear of negative repercussions to our sovereign rating is unfounded,” he said.

Ong also said that the government did not take into account other considerations when deciding to pay KDSB bondholders.

“The justification behind the decision to ‘pay according to what has been decided much earlier, according to the schedule that was set a long time ago’ is a sweeping one and indeed foolhardy,” said Ong, referring to what Transport Minister Datuk Seri Kong Cho Ha said on Wednesday.

Kong insisted the payment schedule must be adhered to.
He added that the government did not guarantee the payments as there were no letters of guarantees given but only letters of support issued by former transport minister Datuk Seri Chan Kong Choy, who had in turn asserted that these did not amount to guarantees.

“In other words, the government is under no direct legal obligation to pay the bondholders,” said Ong.

He added that as the SPVs’ right to payment were subject to what was lawfully due to KDSB under the principal agreements. “It makes absolute sense to withhold payments to the SPVs pending determination of what is lawfully due to KDSB by the courts.”

Ong also said that “new facts” have been discovered — letters apparently revealing that KDSB had given undertakings or guarantees that it will cover any shortfall in repayments towards the bondholders.

Such letters should relieve pressure from the government to pay the bondholders till after the legal suit was settled as KDSB would make up the shortfall, explained Ong.

PKA has sued KDSB for about RM1.6 billion over alleged wrongful and excessive claims for works done. It, however, is scheduled to pay RM372 million to two KDSB SPVs by the end of this month.

On September 25 last year, PKA filed a lawsuit against KDSB seeking to either rescind previous development agreements and a declaration that KDSB is only entitled to reasonable compensation, or a declaration that all invoices and billing notices issued by KDSB to be null and void.

Of the RM372 million, RM222 million is owed to Free Zone Capital Bhd (FZCB) and RM150 million to Special Port Vehicle Bhd (SPVB).

PKA had last month paid RM350 million to another two KDSB SPVs — Transhipment Megahub Bhd and Valid Ventures Bhd.

PKA was forced to take a RM4.6 billion soft loan from the Ministry of Finance after costs ballooned from the initial estimate of less than RM2 billion. The loan tenure is 20 years and the first repayment is expected in November.

PKFZ: 'Gov't will pay the RM700mil to bondholders'

Deputy Transport Minister Abdul Rahim Bakri has given an assurance that the government will pay what is due to the Port Klang Free Zone (PKFZ) bondholders.

“We have a commitment to the bondholders, therefore we have to fulfill it," he told the House today, when winding up matters relating to the ministry in the 10th Malaysia Plan.

He was replying Lim Kit Siang (DAP-Ipoh Timor) who had asked whether Port Klang Authority (PKA) would make any payments to PKFZ turnkey contractor Kuala Dimensi Sdn Bhd (KDSB), given the legal dispute between them.

NONEPKA is due to pay RM723 million to the bondholders tomorrow, akthough it has taken KDSB to court for alleged overcharging.

The Internal Revenue Board (IRB), Lim noted further, has also asked PKA to pay RM328 million owed by KDSB in alleged backdated taxes.

Given such a scenario, Lim suggested that the government should consider setting up a third-party account until the dispute is resolved.

Should PKA decide to pay both parties, they would have to cough up over RM1 billion.

On the same matter, Tony Pua (DAP-Petaling Jaya Utara, centre) said PKA should not make any payments to the bondholders since it was KDSB that had raised the money to finance the PKFZ project through the issuance of bonds worth RM4.6 billion.

azlan“PKA's obligation is not towards KDSB's bondholders,” Pua argued.

Bondholders can either individuals or companies who have invested and bought the PKFZ bond from the market.

At a press conference earlier, Pua had said that the government should hold back payments to KDSB until the court case is finalised.

"PKA can withhold payment to KDSB bondholders on the basis that KDSB had failed to complete its work. PKA could also refuse to pay IRB on the same (grounds). So if PKA says 'I do not owe money to KDSB', it is not compelled to pay the taxes owing to IRB," he explained.

'Perfect scam of the century'

If the government pays both the bondholders and the IRB, said Pua, "this would be the perfect scam of the century".

PKA will have to pay a total of RM1.05 billion to both IRB and the bondholders.

"The result will then be ... the IRB gets to collect its taxes, the bondholders get to recover their investment with interest, while KDSB escapes its obligations without having to fork out a single sen of its tax (owed to IRB)," he claimed.

NONEHe added that this will also save KDSB owner Tiong King Sing (left), who is Bintulu MP, from being sued by the IRB and bondholders.

However, the burden would then be transferred to the rakyat.

"The complete burden amounting to billions of ringgit is shifted to the hapless and helpless rakyat who will be forced to pay for the follies of the BN government," he added.

"(This would) enrich KDSB and its shareholders while those possibly guilty of criminal breach of trust such as former transport minister Chan Kong Choy (will) get away scot-free."

Wee alleges plot out to tarnish his image

UPDATED

By Neville Spykerman

PUTRAJAYA, Jan 28 — MCA Youth chief Datuk Wee Ka Siong (picture) today lashed out at his political enemies within the party for implicating him in the Port Klang Free Zone (PKFZ) scandal.

“They are using the newspapers and instigating non-government organisations (NGOs) and the opposition to lodge reports against me.” said the deputy education minister who declined to name those responsible for the onslaught of allegations.

Yesterday, Seremban MP John Fernandez lodged a report with the Malaysian Anti-Corruption Commission (MACC) against Wee, handing over a five-page statement complete with an appendix running to almost 200 pages.

He claimed Wee had a conflict of interest when doing work for the scandal-hit PKFZ while he was a deputy minister. Fernandez said Wee should be investigated for any improprieties and also the status of his shareholdings in consultancy firm Hijau Sekitar Sdn Bhd, where he is a substantial shareholder despite his denials.

Wee’s consultancy, together with four other firms, had been commissioned by Wijaya Baru Sdn Bhd to do a study on the need for port development in Port Klang. Wijaya Baru is the parent company of Kuala Dimensi Sdn Bhd, which was in charge of the controversial billion-ringgit PKFZ project.

Wee today said he did not blame Fernandez for raising the issue which was based on inaccurate newspaper reports. Inaccurate newspaper reports ? This pig only snorts !! Fernandez report is based on the SSM print out that says you still have or own 49999 shares in your company out of 100000 shares . Sorry lah you are fighting your own shadows ! Just can't understand how they can make you a Dep.Education Minister when you can't even talk something logic . What you have been saying all these while , is nonsense and keep on repeating nonsense .

All the time what these people have been saying is very clear that according to the SSM records , you still own 49999 shares in your company Hijau Sekitar Sdn Bhd , and all these while you have been saying you have disposed of your shares in the company to be amended later on by you that you do not have a controlling stake in the company which the records show otherwise ! So which is correct and stop blaming others in and out of MCA . Aiyoh can't help people with piggy brains like you , after all nothing unusual since you talk , act, look like a pig , not only a pig , but a fat arse idiotic pig .

He said that his firm was tasked with carrying out the work in 2004 and 2005, and he was only appointed a deputy minister in 2008.

“I also never denied that I did not have substantial stakes in the consultancy. What I did say in previous press conferences was that I had sold a majority stake in the company.”

Wee also played clips of his previous press conference on Dec 24 to prove that he was misquoted.

“It’s an hour long and in three languages for all those who want to view it.”

He also made available his assets declarations on three occasions, including while he was MP and after he was appointed a deputy minister.

Wee pointed out that both the PricewaterhouseCoopers report on PKFZ and the special task formed to investigate the spiralling cost of the project made no mention of his involvement.

Yesterday’s report was not the first time allegations were made against Wee.

Last week, Malaysian Anti-Corruption Commission (MACC) adviser Tan Sri Robert Phang urged Wee to co-operate with the graft-busters over similar claims of Wee’s involvement with PKFZ but his press conference was cut short when Wee’s lawyers came in and served Phang with a court injunction barring him from elaborating further.

Wee today produced a formal apology from DAP vice-chairman Tunku Abdul Aziz who, in a letter published in The Sun yesterday, admitted that he had been totally wrong in his conclusion about Wee’s behaviour.

“I have been less fair to him in the circumstances and I owe it to his sense of fairness and honour to admit my mistake of inputting an improper motive to an innocent person,” Tunku Aziz had written.

Wee said Tunku Aziz had also personally called him and added that he was touched by the gesture of someone who was older than him.

While Wee declined to name the individuals involved in the conspiracy against him, he hinted it was common knowledge.

“You understand.” he said adding that the allegations against him surfaced only in October last year.

This was when an MCA Emergency General Meeting (EGM) was held. The tussle for the party’s leadership is still on-going.

“They are out to get me but I will not be shaken.” he said.

Wee this is your KARMA !

PKA, KSDB in a tussle over PKFZ lawsuit arbitration

By Lee Wei Lian

PETALING JAYA, Jan 27 — Kuala Dimensi Sdn Bhd (KDSB), the main contractor of the scandal-hit Port Klang Free Zone transshipment hub, now wants the lawsuits that were brought against it by the Port Klang Authority (PKA) to be settled through arbitration but the latter has disagreed.

KDSB has applied to court for an order to stay the proceedings in two of PKA’s lawsuits alleging that the dispute between the parties ought to be referred to arbitration. KDSB’s stay applications in both the lawsuits are fixed for case management on Feb 19. The company also has pending suits against PKA and its auditing firm PricewaterhouseCoopers.

But PKA has obtained an order at the High Court to restrain KDSB from proceeding with the arbitration process pending the court’s determination of their stay applications. KDSB is appealing to the Court of Appeal against PKA’s High Court order.

“We want the lawsuits to be heard in an open court system as the matter is also of interest to the public,” PKA chairman Datuk Lee Hwa Beng (picture) told The Malaysian Insider today.

“It is fairer. If you have arbitration, only one person decides and you cannot appeal,” he added.

KDSB deputy CEO Datuk Faisal Abdullah claims however that they are not trying to delay the legal proceedings but want the matter to be resolved as soon as possible and pointed out KDSB was also taking some risk by pushing for arbitration.

“Arbitration is final. We are taking some risk too as if we lose we cannot appeal. This is the fastest way to resolve things,” he told The Malaysian Insider when contacted. “We want finality.”

PKA has to-date filed four civil suits at the Shah Alam High Court against KDSB, BTA Architect and former PKA general manager Datin Paduka Phang Oi Choo (OC Phang).

The first suit against KDSB was filed last Sept 18, challenging the validity and computation of interest charged by KDSB for the sale of the land to PKA. KDSB has entered appearance to the suit and also filed and served its defence on 4 January this year.

The second suit against KDSB was filed a week later on Sept 25, seeking a declaration that the increase in the interest rate from 5 per cent to 7.5 per cent per annum in respect of a supplementary agreement for additional development works signed in April 2006 is null and void.

A third suit was also filed against KDSB and BTA Architect on Sept 25 that was related to key development agreements and supplementary agreements signed between February 2003 and November 2006, and PKA has sought for declaratory orders and damages against both the defendants.

The fourth suit was filed by PKA on Oct 8 against OC Phang for breaches of fiduciary, contractual and common law duties to PKA. OC Phang has entered appearance to the suit and her defence is due to be filed by Jan 31. OC Phang has in the meantime filed an application in court for discovery of documents. She has also been charged for criminal breach of trust in the PKFZ scandal.

Apart from filing the civil suits in court, PKA has lodged various police and MACC reports and complaints to various disciplinary bodies.

What arbitration ? Only one person decides ? And you cannot appeal, ? What Bullshitt is this KDSB ? deputy CEO Datuk Faisal Abdullah ?

“We want the lawsuits to be heard in an open court system as the matter is also of interest to the public,” PKA chairman Datuk Lee Hwa Beng, that's the way to go man , never give them an inch , they'll have you eaten alive !

Wee accused of insider trading

Wednesday, 27 January 2010 16:18
top-story-1PUTRAJAYA - DAP turned the screws on Dr Wee Ka Siong, alleging he might be involved in “insider trading” over land development next to Port Klang Free Zone (PKFZ).

john-fernandezIn handing over a five-page report to the Malaysian Anti-Corruption Commission (MACC) yesterday, along with an appendix of almost 200 pages, Seremban MP John Fernandez (right) said the deputy education minister should be investigated for any improprieties in his ministerial conduct and also the status of his shareholdings in consultancy firm Hijau Sekitar Sdn Bhd.

Still a substantial shareholder

Fernandez said a search in the Companies Commission of Malaysia on Jan 25 showed that Wee held 49,998 shares in Hijau Sekitar, while company directors Lim Kit Siong and Wong Woon Ping held 50,001 and one share respectively.

The DAP man had also couriered a copy of the report to the Attorney-General’s Chambers and the Inspector-General of Police.

Dr Wee’s consultancy, together with four other firms, had been picked by Wijaya Baru Sdn Bhd to do a study on the need for port development in Port Klang.

wee-ka-siong-pkfzWijaya Baru is the parent company of Kuala Dimensi Sdn Bhd, which was in charge of the controversial billion-ringgit PKFZ project. Kuala Dimensi is headed by Tiong King Sing, who is also the Bintulu MP.

Seeing conflict of interests

Wee had on Dec 24 last year said that while Hijau Sekitar provided consultancy work on Port Klang it did not do any work on the PKFZ project.

Said Fernandez: “Since the (deputy) minister has admitted that his company Hijau Sekitar has done work for Wijaya Baru, investigations must be carried out to see whether there has been any breach of ministerial rules, for example, doing business whilst being in Cabinet.

Wee, who is also MCA Youth chief, said Hijau Sekitar provided consultancy work on Port Klang but denied any link to the controversial Port Klang Free Zone (PKFZ) project.

Doubts and suspicions

“The relevant authorities must also investigate as to whether the (deputy) minister has made use of inside knowledge of PKFZ development programmes for personal gains. This is because it is alleged that Hijau Sekitar has headed a team of consultants to draw up plans to build a new port next to PKFZ. Has he gained inside knowledge about adjoining land appreciation?” said Fernandez.

He urged the authorities to investigate suspicions that Wee, who is also the MCA Youth chief, may not have revealed all his assets as required to the prime minister when he was elected to Cabinet.

Phang: Why is Wee jittery over PKFZ?

Friday, 15 January 2010 14:19

KUALA LUMPUR - MACC panel member Robert Phang has asked Wee Ka Siong why he is offended by statements linking him to the multi-billion ringgit Port Klang Free Zone (PKFZ) fiasco.

In a statement released today, Phang said the MCA Youth chief "has even threatened to take legal action over statements he had made on the matter.

No accusations made

"I did not accuse him of benefiting from PKFZ. Wee admitted that his former consultancy firm Hijau Sekitar Sdn Bhd was engaged by Wijaya Baru Sdn Bhd to produce a feasibility study of port expansions in Klang."

Phang asked, "Isn't PKFZ part of Port Klang? Isn't PKFZ under the Port Klang Authority?

robert-wee
Phang (right) says he is not accusing Wee of benefiting from the PKFZ project.

"Isn't Wijaya Baru owned by tycoon and Bintulu MP Tiong King Sing who also controls PKFZ's turnkey contractor Kuala Dimensi Sdn Bhd?"

Phang clarified that what he was saying was "that Wee could be an important and useful witness for the police and Malaysian Anti-Corruption Commission (MACC)'s probe into the nation's biggest ever project scandal."

"Not only has Wee admitted having business deals with Tiong, he has yet to clarify his business relationship with Tiong," he said.

Accountable to electorate

Phang aslo said that Wee, as an MP and deputy minister, was obliged to observe transparency and clarify doubts that arise in any issue, be it the PKFZ or others.

"You (Wee) are accountable to the electorate.

"The police and MACC cannot be seen doing a lax job in its pursuit to bring to book those who have plundered taxpayers' money via the PKFZ project," said Phang.

He said the authorities must pursue every possible link or lead, not necessary leading to the prosecution of a witness.

"And this includes Wee," said Phang in the statement.

He said that the PKFZ fiasco has affected the government and nation's integrity in the international investment arena.

"The actions taken by the government and the final outcome of the probe will determine whether foreign investors will continue to have confidence in Malaysia as a premier business destination, said Phang.

"The government, therefore, must allow the police or MACC to act against anyone, including those holding high office.

Phang also pointed out that Wee has been saying that he had no basis to comment on issues affecting MCA leaders because he was not a party member.

My comment : I am shocked that Wee can say that just because people like you and others who are non MCA members have no right to criticise or comment on him . I am further shocked that he has not and refrained from saying this to William Cheng the ACCCIM big mouth who speaks with his foot in his mouth and who I believe is also a non MCA member but happens to be Liow's por lam pah .

'Shocked by lack of understanding'

"I am shocked by his lack of understanding in the relationship between a political party like MCA and the citizens who every five years elect their leaders," he said.

"If he doesn't like my views, that is his right. But as a citizen, I have every right to comment and state my stand on issues, especially political, afflicting the nation," said Phang.

He said he need not be a member of any political party to cast his vote in a general election.

"Wee is living off taxpayers' money and therefore he must look after the interest of taxpayers.

"My humble role as a senior citizen and as a member of the MACC advisory panel makes it even more important for me to ensure the MACC is a credible watchdog for the voters," said Phang, who is also Social Care Foundation chairman.

Phang asked "Wee to display more leadership quality and transparency on issues of public interest instead of showing contempt and disrespect to the elders who may not share his views."

Wee this is not England !

In case you are not aware of English laws , any would be burglars or thieves in England and who gets injured while attempting or in the act of committing buglary can sue the owner of the house who may or may not be around at the time of the burglary .

Press Statement by MCA Youth CC member Ding Keng Long

More Questions than Answers

Press Statement by MCA Youth CC member Ding Keng Long on Dato' Wee Ka Siong's Links with Dato' Seri Tiong King Sing

I refer to Deputy Education Minister Dato' Dr Wee Ka Siong's recent media statements regarding the involvement of his ex-company, Hijau Sekitar Sdn Bhd, with another company linked to Dato' Seri Tiong King Sing of the PKFZ fame. I find many inconsistencies in his statements and far from clearing up the controversy, Wee's explanation has only served to further confuse MCA members and the public. They also raise doubts over his assertion that he and Tiong are not in cahoots. Among the inconsistent / doubtful statements are:

1) During a media conference on Christmas eve last year, Wee had said that Hijau Sekitar, in which he used to owned sizeable shares, had indeed done work for Wijaya Baru Sdn Bhd (Tiong's company) for free. But within a week or so, Wee retracted by saying that he had never said he did pro bono work.

Which is which? If he was misquoted in the media, what took him so long to come out to clarify on a contentious issue ? Didin't he know that by keeping quiet, he had only helped fuelled speculations that he and Tiong were in fact very close to the extent that his company could do work for free?

2) Wee had said that the foreign consultants who jointly did the feasibility study with him for Tiong's company were reimbused. If so, did Wee fork out the money on his own or did Wijaya Baru paid the consultants? If he had paid the consultants on his own accord, why did he do so? Does he have a stake in the project, had it been approved by the Ministry of Transport?

3) Wee had said in media reports that Hijau Sekitar, like doctors, do not choose clients. I find that preposterous because the cash-flushed Tiong and Wijaya Baru is not your typical walk-in client. As a seasoned politician, surely Wee knew that Tiong is a central figure in the Port Klang Free Zone. Besides, the feasibility study undertaken by the five consultants led by Wee involved a long-term project for a new port facility. Surely, a lot of in-depth discussions had taken place prior to coming up with the report, especially considering the fact that Tiong is well-versed in port-related matters, having developed the PKFZ next door.

Hence, I think Wee is not only insulting the public by saying that Tiong is a walk-in client, he has also demeaned Tiong, by likening the Bintulu MP and jet-setting tycoon as a run-of-the-mill client.

4) Wee had failed to answer why he had earlier denied having done work with a company linked to Tiong, as contained in an interview with The Sun newspaper on October 30, 2009. Wee had then said that the burden of proof was not on him. Now that a link has been proven, what has he got to say now? Why can't he be a gentleman and said that he had made a mistake by denying his earlier links with Tiong?

Now, Wee is saying that he is not involved in PKFZ, much less its gigantic financial scandal. Is he prepared to say that the onus is on the accusers to prove? What would he say if there there is evidence to prove the accusers right? Would he be man enough to admit his mistakes then?

5) What about his denial in the New Straits Times on Dec 31, 2009 that none of his staff had ever worked for Tiong. If someone can show documented evidence to prove Wee wrong, would he be honourable enough to retract and apologise?

6) Wee had said that the project he did for Tiong had nothing to do with PKFZ. But surely as lead consultant, he knows that the project is located adjacent to the controversial PKFZ. Is he saying that as lead consultant, he could come up with a proposal for a new port without having an in-depth knowledge of PKFZ, which is located next door?

Is he saying that issues like PKFZ's fundamentals, potential and some of the proposed massive infrastructural work there has no bearings on his proposal? Was Wee privvy to the planned infrastructural work in PKFZ? Was Wee or Tiong - or both - hoping to piggy-back on the Government's massive investment in roads, telecommunications and other amenities in PKFZ?

7) If it's true that Wee was indeed close to Tiong (which is not wrong at all, legally), did Wee provide any input to the Wijaya Baru boss on the feasibility of PKFZ, in the same manner he came up with a proposal to study the "feasibility of a new port facility" in Mukim Jugra Selangor in 2005?

The above points / questions are not mine alone, but are burning issues that hang over the minds of the MCA grassroots. They had come to me hoping that I could escalate their concerns and doubts openly.

It is now imperative for Wee to come clean once and for all and clear the doubts the grassroots. As a public leader, MCA Youth head and Deputy Minister, the grassroots demand an explanation. They do not want to see more party leaders entanggled in the PKFZ mess.

Provide evidence or step down, Wee told

PETALING JAYA: Deputy Education Minister Datuk Dr Wee Ka Siong should provide evidence to back up his accusation that the Transport Ministry is behind the release of information on his alleged involvement in the Port Klang Free Zone (PKFZ) failing which he should be honourable and step down, said Simon Lim, the political secretary to the Transport Minister.

Lim said Dr Wee’s accusation had seriously affected the ministry’s good name, including that of its officers.

“He needs to be reminded that as a deputy minister, he should not make unwarranted, baseless and unsubstantiated accusations.

“There are proper decorum and protocol to be followed if he wishes to lodge a complaint but definitely not by making sweeping statements,” said Lim yesterday.

It was reported that Dr Wee had likened allegations of his involvement in the project as a “political assassination” as any such information was included in the Port Development Report, which was only available to the Transport Ministry.

He had claimed that bloggers would not have obtained the information unless this had been released by the ministry.

Dr Wee had earlier admitted that his former company, Hijau Sekitar Sdn Bhd, had provided consultancy work on Port Klang.

Lim pointed out that the consultancy arrangement was a “private arrangement” between Dr Wee’s company and PKFZ turnkey developer Kuala Dimensi Sdn Bhd.

“Any reports prepared would be accessible by third parties. Hence, pointing fingers at the ministry is an indiscriminate and judgmental act,” he said.

Someone posted this comment in my other article a few days back ....its very logical and I wonder what fat Wee has to say to this comment :

Simple. Just go through the terms of reference for the Port Study by Hijau Sekitar. The Port understudy is in fact a feasibility study of creating PKFZ (2), an extension of current PKFZ with the assumption that the existing facilities are fully utilised or occupied. Question is how can one provide future projections without having to refer to the current PKFZ Project. Where is Hijau Sekitar going to obtain data. Definitely from KDimensi or TKS, the turnkey contractor for current PKFZ. There is no denial that there is a link between the current PKFZ study and the study undertaken by Hijau Sekitar on behalf for KDimensi.

Finally Revealed - The secret relationship

Finally revealed - secret PKFZ documents that will net the Big Fish

Pop quiz: Who is the Big Fish the Attorney-General promised he will drag to court over the PKFZ fiasco? Those who think pictures of Tiong King Sing, Chan Kong Choi and Ling Liong Sik in handcuffs will grace the front pages of newspapers might as well wish for full-frontal nudity in Malaysian mainstream media. Everyone knows they are Political Untouchables.

THE CORRIDORS OF POWER

I Love Malaysia

Besides, if the AG had wanted to, these big-time sharks would have been charged together with ikan bilis like OC Phang and others whose names you cannot even remember. The thing is, the AG is not so silly as to raise public expectations about netting a Big Fish (http://www.bernama.com/bernama/v5/newsgeneral.php?id=461498) without actually doing it. That would be politically-suicidal. Very few people know that the A-G's Chambers is now working overtime to build a case against a senior BN leader following the recent emergence of some damning documents.

The first series of the said documents was deposited at the AG's Office in Precint 4, Putrajaya, on a Sunday morning by a Bangladeshi worker who thought no one was in the office (the staff were then rushing through the GST bill). The 2-volume documents implicate a man, whose involvement in the RM12 billion fiasco was only spoken in hushed tones before this, due to lack of evidence. But now, documented evidence has started to surface about the involvement of Deputy Education Minister Wee Ka Siong in the PKFZ mess.

The latest daming documents show that Hijau Sekitar Sdn Bhd (240539-X) did consultancy work for Wijaya Baru Sdn Bhd (205953-X) on "the feasibility of a new port facility on reclaimed land at the mouth of Selat Lumut in Port Klang" in 2006. Hijau Sekitar, established in 1992, is owned by WKS, who has 49,998 shares. The remaining shareholders are one Lim Kit Siong (50,001 shares) and Wong Woon Ping (1 share). Wijaya Baru, as we all know, is the parent company of Kuala Dimensi Sdn Bhd, the turnkey contractor which made PKFZ its own goldmine. (Please refer to the documents, including a company search).

Here's the background and some lowdown: Back when PKFZ was starting to take shape and when no one could ever imagine it would become the biggest financial scandal in Malaysian history, two prominent businessmen wanted to make some quick bucks. Westport boss Tan Sri G. Gnanalingam and Tiong King Sing each bought a piece of land adjacent to PKFZ, a project modelled after the highly-rated Jebel Ali Free Zone.

Being privy to the information about the massive infrastructural developments that would take shape in next door PKFZ, the duo had wanted to piggy-back on what they then thought would be a foundry for golden eggs-laying geese. The duo was aided and abetted by WKS through his little-known consulting firm, Hijau Sekitar, which headed four other consulting firms.

Had PKFZ succeeded, the port facilities would have been leased to the Port Klang Authority on a long-term basis for a price more handsome than the love-struck Bung Mukhtar. And let's not forget the windfall from price appreciation of the two plots once PKFZ was in full-swing. Tiong King Sing and WKS would have made billionaire golfer Tiger Woods (who was recently Chua Soi Lek-ed) look like a pauper.

See also Wee Ka Siong - The Missing Link

In other words, WKS, through his buddy TKS, wanted to have a second milking of the cash cow (the first being PKFZ proper). It was a plan so well thought out, the duo could have just carted away in broad daylight whole military aircrafts, not just its engine parts like how some corrupt Mindef officials did. Credit must be given to Mastermind Wee (as lead consultant) for a plan so ingenious, it could only have been inspired by sheer greed.

Alas, Ong Tee Keat messed up their Grand Design by opening the can of worms that is the PKFZ. Now, not only are the crooks not getting the second bite of the cherry, they are going to need to bite the bullet. The A-G's Chambers and the MACC are now poring through 7 boxes of documents seized from Port Klang Authority's office on Dec 4 to determine the extent of which WKS breached the Official Secrets Act by acting on classified information. Highly-placed sources said WKS will also be charged for economic plunder and grand larceny in the first two weeks of 2010.

But legal problems aside, the political fallout for the MCA Youth chairman following the surfacing of such documents would even be greater. The documents clearly show that WKS is closely linked to Tiong King Sing, who is gunning for Ong Tee Keat over the PKFZ issue. His denial of links with Tiong (http://www.sun2surf.com/articlePrint.cfm?id=39583) is now proven to be a blatant lie.

It shows why WKS is so impatient to topple the MCA president, when it was clear as daylight that the Youth Chief himself, given his credentials, was president-in-waiting. Even WKS's own aide in the Education Ministry used to be a staff of Wijaya Baru and was collecting a salary from Tiong. WKS was also the one who laid the trap for Ong Tee Keat to board Tiong's private jet and then leaked the details in the Internet. (More of WKS's lowdown here: ttp://www.malaysia-today.net/index.php?option=com_content&view=article&id=28157:wee-ka-siong-the-missing-link-in-the-pkfz-mca-crisis-debacle&catid=71:archives-2009&Itemid=100106).

But crybaby WKS underestimated those who abhor traitors and the reach of closet whistleblowers who can't stand hypocrites and plunderers. The documents below are only the first batch. More will be released in due time. By then, Liow Tiong Lai’s wife run-in with the MACC over the Toyota Alphard scandal will look like a noble deed.

Next the Big Fish ?

Authorities to net PKFZ 'big fish
'

Chinese dailies Nanyang Siang Pau and China Press have fingered Bintulu MP Tiong King Sing as the next person likely to be brought to book over the Port Klang Free Zone (PKFZ) scandal.

Both the sister dailies featured articles on their front pages alluding to this.

NONEAccording to Nanyang, "reliable sources" told the paper that "action" would be taken against Tiong without any specifics.

China Press on the other hand said that a 'big fish' of high social standing would be held today but did not name the person.

However, the China Press report carried a large silhouette image which bore a striking resemblance to the stocky Tiong.

Tiong currently oversees

Checks by Malaysiakini revealed that Tiong - a business tycoon from Sarawak - is overseas and it is uncertain when he will return.

NONESince last Thursday, four people have been charged in connection with the troubled PKFZ project, and Attorney-General Abdul Gani Patail promised that more would be hauled up.

This led to speculation that Tiong and former transport minister Chan Kong Choy would have to face the music.

Tiong is a major stakeholder in two companies Wijaya Baru Global Bhd and Wijaya Baru Holdings Sdn Bhd, which own PKFZ turnkey developer Kuala Dimensi Sdn Bhd.

Chan is said to have breached laws during his tenure by issuing several letters of support, without the Treasury's permission, to help Kuala Dimensi raise bonds.

DPM: Action shows Govt is transparent

MALACCA: The charging of three people over the Port Klang Free Zone (PKFZ) issue showed the Government’s stand on transparency and bringing to book those who flouted the law, Tan Sri Muhyiddin Yassin said.

The Deputy Prime Minister said action could be taken against any individual if the authorities or the Attorney-General found evidence of wrongdoings.

“This shows our stance on the PKFZ issue is transparent, as stated by the Prime Minister,’’ he told reporters after opening the One District One Industry (SDSI) Showcase 2009 here yesterday.

He added that the decision to charge those in connection with the issue also dispelled the perception that the authorities were “protecting” those who might be involved.

Former Port Klang Authority (PKA) general manager Datin Paduka O.C. Phang and two senior officers in companies involved with the PKFZ issue were charged in the Sessions Court on Thursday with offences amounting to RM$380mil.

Muhyiddin was asked to comment on the arrests and charges brought against the three individuals.

The mother of three also historically became the first woman and Malaysian to be elected president of the International Association of Ports and Harbours in its 52-year history, from May 2007 until April 2009.

Previously, she had been the association’s first vice president from May 2005 until April 2007.

More to be charged for PKFZ scandal

By Adib Zalkapli

PUTRAJAYA, Dec 10 — Attorney-General Tan Sri Abdul Gani Patail promised today that more people will be charged over the Port Klang Free Zone (PKFZ) scandal, with a few more individuals expected to be arrested next week.

He gave few details about the matter except to say that the probe was still ongoing, and that an engineer with Kuala Dimensi Sdn Bhd (KDSB), the turnkey contractors for the project, would face unspecified charges in court on Monday.

Earlier today, Datin Paduka OC Phang, a former general manager of the Port Klang Authority (PKA), along with Bernard Tan and Steven Abok, became the first people to be charged with criminal breach of trust (CBT) in the scandal, two years after suspicions surfaced about shady deals behind the construction of the country’s landmark PKFZ.

So far it is unclear if more personalities — such as former transport minister Datuk Seri Chan Kong Choy or Datuk Seri Tiong King Sing, who controls KDSB — will face any action.

But Gani’s remarks today are likely to give rise to some speculation about their fate.

Phang has posted a bail of RM350,000 after claiming trial to three charges for CBT amounting to RM254 million and will have to surrender her passport on Jan 12 when her case is mentioned. She had asked to delay surrendering her passport as she will be in the United States between Dec 14 and Jan 9.

Both Abok and Tan have also posted bail. The court had set a RM200,000 bail for Abok, who is chief operations officer for KDSB after he was jointly charged for two offences of cheating amounting to RM5.4 million, and Tan, an architect with BT Architect, was given bail of RM250,000 with one surety for charges of CBT amounting to RM122.3 million. Their case will be mentioned on Feb 4.

Tan was also charged with 24 other offences, together with another person who has yet to be arrested or identified.

Tiong and the RM10 million donation.

Flaws in Tiong's 10 Million donation

I have been following with much interest the statements by Bintulu MP Tiong King Sing, whose company Kuala Dimensi Sdn Bhd (KDSB) is a key component in the Port Klang Free Zone (PKFZ) fiasco.
In his public spat with MCA president Ong Tee Keat, I do find some of Tiong’s statements rather confusing. - Liew Nam Chee

Taikor looks so lancie with a kuai lan face

Loan or Donation?

He has earlier first claimed that it was a loan given to Datuk Seri Ong Tee Keat for MCA political activities. Subsequently, after having realized that it would not be believable he took a 360⁰ turn and alleged that he has given a cash donation of RM10 M to Datuk Seri Ong Tee Keat for MCA activities. Why the loan theory is not believable? Datuk Seri Ong would not be so stupid to take a loan for MCA as he will be personally liable to repay the loan if the Party failed to repay the loan. If it is loan, it got nothing to do with the Party. So the “donation” plot would be perfect as it would cause the members of MCA to go against their President for pocketing the money meant for MCA. A very clever twist.

Unfortunately for Ong, there are gullible party members. Worse, he has detractors from within and these people have added fuel to the fire.
But the party president has explained the issue clearly and publicly. In his on-going meetings with party members across the country, many are said to be convinced that Ong was telling the truth.
Ong has declared that his conscience is clear on the RM10mil allegation. I think that as long as he believes he has done no wrong, the MCA president has nothing to fear.

Listen to the taikor speaking here on
I'm not BN's ATM, says deep pocket MP

Hear the taikor speaking refine or unrefine ? speaking like gangster No ?
He said : to be fair to him , he NEVER ask the amount , I am the one to offer ,
Want to give money , tell the whole world ?

The ‘Private Jet Issue’

Revelation of “Private Jet Issue” to corroborate the allegation of RM10 million.
Taking the private jet is an undeniable fact. If the first allegation (the taking of the private jet) is true then it would made the second allegation (RM10million) more convincing and believable. This plot seems to work quite nicely. But if one is to give a serious thought about it, one can see that it was used to create a smoke screen to make the “RM10 million allegation” more exciting. Be careful the next time you take a free ride from an acquaintance. But the bottom line is where the proof?

Is Ong the only one taking free rides from him ? What about other UMNO leaders who have also been enjoying free rides from him thru his Deputy ?
What about the fact that when he found out that he doesn't have a Charter License , they changed the tuned to billing Ong only the fuel and airport charges amounting to 10,000 ringgit ?
Until today , we have yet to see the invoice for the fuel charges !

The Proof of taking RM10 million cash

Here comes the mother of all plots. First, it was claimed that the money was placed in the briefcase. After having realized that it would take huge numbers of briefcase to contain the cash, he again took a swift turn to say that it has placed in two “fruit boxes”. Sound familiar if one is to follow ex Taiwan President Chien’s case.

To strengthen his claim, here comes the instrument of Statutory Declaration. Sound familiar again isn’t? Yes, the case of Dato Seri Anwar Ibrahim (first sodomy case Munawar Anees and his adoptive brother Sukma Darmawan Sasmita Atmadja; the second case, saiful) and Altantuya (P. Balasubramanian). The most rampant abuse declaration used by politician nowadays. Datuk Chua Soi Lek’s camp is now using this too in calling for an EGM. Those who have signed it unknowingly may fear of legal implication if they wish to withdraw the declaration. Creating a fear factor.

Statutory Declaration a big word but it is merely a declaration under oath just like one do when given evidence in court. But to the public it gives a different perspective. Clever isn’t it. Give the guy RM100k and he would happily give you the Statutory Declaration because it is just a declaration under oath. “Sumpah sahaja” . Chicken feed-lah. For God sake, who is Tiong King Sing going to con now.
Seriously, who do you want to believe now?

We will deal with that SD in our next article tomorrow .

Conspiracy against PKA

To understand the meaning of cahoots to defraud , to cheat , we must piece all the jigsaw together , then only will you see the full picture . Who Appointed OC Phang ? Phang was appointed by Ling Liong Sik !! Is this one of the reasons why Ling is now Openly Supporting CSL to oust Ong Tee Keat ? What is Phang's connection to the incoming GM Lim ? Did she influence Lim on a possible sweetener from someone we all know ? Please see previous article , should be read together to piece the jigsaw together .

PETALING JAYA (Sept 6, 2009): The cabinet will be told on Wednesday that several parties, including former Port Klang Authority (PKA) general manager Datin Paduka O.C. Phang and turnkey contractor Kuala Dimensi Sdn Bhd (KDSB), were named as "possible conspirators" who have harmed or injured PKA in the Port Klang Free Zone (PKFZ) project.

Tiong King Sing O.C. Phang

Cabinet ministers will be given details of alleged deceit, fraud, double-billing and non-existent claims that were submitted for which payment was made with Phang's tacit approval.

The details of these and other irregularities are contained in the report by the Special Task Force which probed the PKFZ fiasco. According to those-in-the-know, the report heavily implicates Phang for losses incurred in the development of the free zone as she had breached her fiduciary duties and made questionable unilateral decisions detrimental to the PKA, without consulting the PKA board.

These findings appear to corroborate contents of a police report lodged by PKA chairman Datuk Lee Hwa Beng last month which accuses KDSB, its CEO Datuk Seri Tiong King Sing, Phang, BTA Architect and consultant Bernard Tan Seng Swee of "alleged conspiracy in the scandal".

The task force headed by Skrine & Co senior partner Vinayak Pradhan briefed Bukit Aman’s Commercial Crimes Division on its findings last week, following which police froze KDSB’s bank accounts totalling RM140 million last Friday.

On Friday, the task force and Inspector-General of Police Tan Sri Musa Hassan briefed Prime Minister Datuk Seri Najib Abdul Razak on the status of the probe.

According to one source, the task force also found that Phang had varied the interest rate of a contract without consulting the board which caused the authority to incur additional costs of RM49 million.

The task force found that Phang had placed the interests of KDSB above those of PKA and denied Government General Orders and Treasury guidelines on a variety of issues related to the project.

Phang had earlier been implicated in PriceWaterHouseCoopers’ (PWC) audit report released three months ago which pointed out, among others, that she had used the Common Seal without approval and had exceeded her authority of entering into contract exceeding RM50,000.

Police are investigating the activities of Phang, who is also alleged to have:
approved fraudulent claims from KDSB;

Accepted only advice favourable to KDSB, sidelining employees who consistently raised costing and budgetary concerns;

Refused to heed legal and professional advice of PKA officers in the appointment of quantity surveyors where she had also delayed the appointment of surveyors, while restricting their role;

Insisted that Perunding BE Sdn Bhd be appointed sole quantity surveyor although she knew that there was a clear case of conflict of interests since the firm was also appointed by KDSB for the same project;

Appointed Perunding BE without approval from the Finance Ministry;

Issued various consents and undertakings, as well as unilateral decisions committing PKA without approval from the board;

Committed PKA knowing very well that it was under budget constraints to fulfil its obligations although the government had agreed that PKA would fund the free zone from its own funds.
The task force findings accuse KDSB of:

Requesting a revision of the infrastructure plan for drainage and piping works claiming that it was unaware of the specifications of these works when the Legal Agreement had specifically spelled them out;

Double-billing PKA for drainage and piping works;

Billed PKA RM55.7 million for electrical infrastructure works which had yet to start;

It holds Tiong responsible as the “directing mind” behind KDSB by virtue of his position in KDSB, as well as being the substantial shareholder (70%) of holding company Wijaya Baru Holdings Sdn Bhd.

The task force, it is learnt, had also exonerated legal adviser Fazilah Surkisah Mohammad, saying there was no evidence of wrong-doing on her part.

On Wednesday, Phang shocked members of the Public Accounts Committee (PAC) hearing on PKFZ when she said she did not remember certain key issues regarding the deal and did not understand the basic financial term “cash flow projections”.

Tiong and KDSB meanwhile have filed defamation suits against Transport Minister Datuk Seri Ong Tee Keat, Lee and PwC.

Business jargon and memory loss

One finds it hard to stomach former Port Klang Authority (PKA) general manager Datin Paduka OC Phang’s claim of memory loss over certain pertinent issues during Wednesday’s hearing.

Even more so is her declaration that she does not understand what the committee meant by "cash flow projections" – prompting PAC chairman Datuk Seri Azmi Khalid to give her an impromptu tutorial.

With a BA from University Malaya and a Cranfield School of Management graduate and years of working in the finance divisions of various ministries, Phang should be more convincing if she wants to play dumb.
