UPDATE : EGM 2 on NOV 28
BREAKING NEWS The problem-riddled MCA will witness another extraordinary general meeting (EGM) on Nov 28, in order to allow central delegates to decide on whether a fresh polls is necessary to resolve the internal crisis.
This news appeared in Malaysiakini , however on checking with party sources , it seems that this EGM is called by Brutus and Conspirators and have nothing to do with the Party .
Therefore this EGM is unconstitutional and NOT sanctioned by the Party .
It only goes to show how desperate these people are to give the public a bad image of the Party , how messy the Party is in , and to give an image that the President cannot control the Party .
If this EGM is thrown out by the court , I have reasons to believe that this will be challenged legally , then the requisitors will have to face the Disciplinary process .

Is the 28th Nov EGM called legal if Wong N C is the one who has sent out the notices.
ReplyDeleteThe number of the initial requisitionists were 16 but at the material time when he sent out the notices only 12 are incumbent after 4 of them have been relieved of their appointments.
I need to be enlightened.
No matter who call for the EGM, make sure that the future of MCA is in the hands of the grassroots, not in the hands of FGZs !!

MCA will be a better party without these office bearers. Otherwise it will just stink as has happen for 50+ years and become irrelevent in the next GE. Dont get too excited. I think Liow and gang are doing this so that OTK will initiate disciplinary actions against them. Then they will cry foul and take this to court. They are trying to get OTK to make a mistake. MCA has no disciplinary committee. OTK need to appoint a new one. Liow and Gang will declare the new committee them as illegal and refuse to recognise it.

ReplyDeleteAs a life member, I would not condone making a mockery out of MCA by these groups of misguided souls. Patience has been running thin. The president and the deputy have done their best to accommodate everyone in the GUP as it is inclusive in nature so that MCA could move forward leaving behind the scars inflicted. But sadly, LTL, WKS and CMF are still adamantly stubborn to share the wishes and wisdom of majority of the CCMs and Malaysians to embraced GUP which has been adopted and endorsed by the CC meeting recently. Failure to support GUP means breaching Sub Article/Rule 9.3 of the Party Constitution. Being Principal office bearers, their actions should not be tolerated as they have set a very bad example to ordinary members as if they are above the law. Datuk Seri LTL with due respect, Democracy means respecting the majority and the Constitution of the party which has been formulated and endorsed by the party subsequently approved by the ROS.

Shift your paradigm and see things at different angles without any attachment or delusion. I am sure as MCA members you still share the sentiment all of us have - to built a strong MCA, regain its dignity and people's trust so that it can serve the country and Malaysians effectively. We have self-respect and with all these sandiwara our esteem as MCA members have been diminished. Look around you and think deeply whether those hanging around you have been sincere in provoking you to institute whatever actions against the party. Wake up and put some senses in you if you still love the party. A good leader will have the capability to anticipate or predict at lease two steps ahead of the consequences if any actions are to be taken. Will the outcome have any backlash to the party?!!!
Frankly, the president has been very patient and magnanimous with all of you. He could have taken actions against you for slandering him in his capacity as the president of the party. But he has not. Restrain. For the sake of the party, reciprocate if the president and his deputy extend his olive branch again. I am sure they have the wisdom to. Discuss as civilized leaders with the objective of healing the wounds. Strictly between the principal office bearers only without bringing in other CCMs. Again, I would like to stress that whatever the leaders do will have to be in accordance to the constitution of the party at this trying time.
Leaders should not give unnecessary destructive statements to the press especially MI. Bring your grievances to the attention of the party.

ReplyDelete1. There is nothing wrong with the EGM notice issued by the representative (Wong NC) of the requisitionists to all the delegates when Sec-Gen did not do so...: Article 31.
2. Liow's gang did not go the court at this juncture and this shows that they wanted to "exhaust all possible avenues & remedies" first. Otherwise they may be caught by the prohibition under Article 175: "No member can take any matter to court until he has exhausted...."
3. But it is apparent that EGM No.2 is not going to take the Liow's gang anywhere. They need 1/3 of the 2380 delegates to have the quorum.
4. The President's men & women (including the recently alive from death's Dr. CSL)only need to boycott this EGM, so that it won't get 1/3 quorum:Article 32 stipulates that an EGM wh does not have a quorum is considered "aborted" after a 30-minutes' wait....
5. With or without EGM, the CC is still the FINAL AUTHORITY to make any decision or intepretation of the provisions of the Constitution: Article 164 & 174. Definitely NOT the EGM requisitionists.
6. Further, there are clear provisions of "exclusion clauses" --CC decisions/interpretations SHALL NOT be subjected to question by or in any court of law....Liow's gang is actually entering the dead corner of the dead end. Where got road already?

Liow says fighting for democracy, not MCA presidency

“I want the party to look good, to be seen as a party of principle, and to get the Chinese to support us again,” he said.

2. Now DS Liow also claimed that he was/is figthing for "democracy" and not "the presidency". Which school of democratic thoughts that he belongs to hah?
3. I tried to understand that Liow behaved as he did, and continued to behave the same...is because it is very difficult to GET DOWN FROM THE TIGER'S BACK ( after a joyful ride at first )....
4. But he has to decide for himself --now or never! With OTK who has opened his arms to embrace him (Liow), I am sure Liow shall remain/survive in the status quo....
5. It is vital that Liow decides quickly, because the 2nd cycle of AH1N1 pandemic is around the corner - unless he is tired already of tackling the selsema babi....

ReplyDeleteWhen Wong NC sent in the request for the EGM he had the required 16 requisitionists being 1/3 of the CC. But with four of them being relieved of their appointments the number of requistionists have been reduced to 12. Thus at the material time when the notices are sent out, the prerequisite of at least 16 requisitionists has not been met thus contravening with Article 30.2 of the Constitution. Consequently making the EGM unconstitutional.
The problems of Liow are:
ReplyDelete1. Wee and Chew are poking fire from the back. They still think they have the number with Youth and Wanita behind them. Until these 2 divisions are cut from Wee and Chew, they will still live as if they have an army. Liow is their shield.
2. Wong Nai Chee, Chor Chee Heung and gang wanted revenge. They felt they were not respected by the summary sacking
3. Of course there are many unseen hands who are not satisfied with the status quo. Their self interests are in danger of being exposed.
None of these will allow Liow to dismount the tiger. There is only one way Liow can dismount and that is horizontally. Fight on he die. Dont fight on he die. He is really in a died game.
The best option is to die with honour. DO the right thing.
Calling for Buddha will not help. Liow make this problem. Only Liow can fix peacefully.

Big snakes (2 of them) have put up over 30 millions as front payment, with promise more to come
That is the main thing that is fueling the FGZs, for this 2nd EGM, and also for the court lawsuits in the future.
What you guys have to watch out for is how many CDs are accepting bribe.
Rumor is that they are focusing on 900 Central Delegates and they intend to bribe those 900 CDs.

But it is always arguable that the requisition is valid at the time of submission to "the Sec-Gen or Party HQ".
That's why ( I guess ) CC did not forward that opinion ( of yours ) as the ground when they rejected the said requisition. Instead, CC opined that resolution no.2 ( on President's power to appoint & dismiss ) was unconstitutional....
Anyway,our debate above is merely scracthing the technicality of the relevant provisions/laws.
I feel that even if the party does not prohibit the EGM so requisited, Liow & Co won't achieve anything --especially if the President's men & women boycott it. This will force it to be aborted for lack of quorum....
Again, this will subject to the possibility that Liow may invoke Article 160 to "adjourn" the EGM (after lacking 1/3 quorum) for one week. This was done by Tan Koon Swan's lawyers when they 'failed' to get the required quorum....
I am not sure if Article 32 is a new provision to exclude the application of Article 160...though it appears to be so....

Anony 539 say Two Avacanda will spend RM30 million for the EGM II. What make the 2 big snakes so lucrative with MCA ? Some OTK/CSL CDs act Mu Kang Dou to find the 2 big snakes and trap it to MACC. Every corner of MCA chinese supports be ready to catch the big snakes for put it into museum ( HANG THEIR BIG PICTURE IN FRONT OF MCA HALL ) or employed professional hunters to catch the BIG SNAKES OF MCA.

Yes, it only technical and the onus is for the party who requisition to prove its legality when the time comes. The number of requisitionists at the time when the requisition is made VS the number of requisitionists at the time when the requisition is executed.

Similarly in regards to the big snake you have to read many articles to get a clear picture like for example you have to read : Raiders of the Golden Star . , Heavenly Kings , etc , and the motive ...like in a criminal court , there must be a motive for the act to have been carried out . So the motive today is of various reasons with the main one being $$$ and putting his brother's political career back on track to eventually becoming the president .
It is also now very clear who is behind Sinchew to write those incongruous articles on OTK besides the Sarawak Tiong . The one who sold Nanyang and China Press during his term of office .
More about him later .
If OKT is the big snake. I am not at all surprised. I never trusted him all these while. For one, as a politician, he look and sound too goody. Girlfriend CMF will not be so active in this debacle without boyfriend behind. Third, brother OKC is too ambitious to let thing down.

There are at least 3 forces working at the backstage, all gang up against OTK:

Chan Kong Choy
OKT / OKC brothers
Sarawak Tiong & gang
They have their respective reason to want OTK to step down, but their aim is the same.
Right now, what I am afraid is that they have GABUNG their force to support the FGZs !
Let us look at the reality:
A.Wang Nai Chee is a nobody.
How is he going to gather the $$$ for the EGM?
B. LTL is a indecisive guy.
Who is behind all his moves (even threatening lawsuits)?
C. Ong Ka Ting is very calculative.
Why is he meeting Najib?
D. Sarawak Tiong, a guy with no principle.
What will he do to OTK if he got a chance?
E. Najib, the flip flop guy.
Najib's heart is not in MCA. All he wants to have an MCA that he can control.
Imagine if you are Najib, who would you side with?
OTK, a person who dare to do the impossible (that might implicate some arm no people into corruption charges)?
Or
People who come to you to offer you the ability to remote control MCA, on a silver platter?

ReplyDeleteWhere was Wong NC when UMNO was deregistered by ROS? Under the Society ACT 1966 all legal associations are under their supervision. Any dispute has to be referred to it for clarification. Datuk Seri CSL's case is constitutionally correct when he sought ROS to determine his position in the party. Saying that a simple letter from the ROS could over-rule the the CDS' decision (EGM) is most naive and naughty which has ulterior motive - to evoke ill feelings towards ROS hoping that CDs will sympathise with LTL.

Calling for an EGM is easy BUT
ReplyDeleteLogistics is another , imagine to get 2400CDs to attend an EGM , you have to book 1200 rooms in the city , assuming two to a room , then CDs are not going to travel from all over the country just to attend a EGM not sanctioned by the party and having to pay out of their own pockets for traveling ( those from Sabah needs to book flights ) Meals , breakfast , lunch and dinner .
Sorry lah we are NOT coming even if its on .
My view of the action is not really to have the EGM. Like Sdr. Justice4otk said, there is major logistical problem that need an organisation to managed. Without MCA's administrative machine at the group's disposal, they will have to setup one. Everything can be solved, but it need money. Lots of money.

The real reason for calling the EGM is evoke bad feeling and hatred for OTK. They are just out to cause mischief.
The best thing to do is to call their bluff. Let them call. Provide not support or money.
It is also not easy for Tiong to give out cash now He spent alot in the last EGM. He cannot tap into KDSB money. These are frozen by the police. KDSB is even having problem paying salary.

To solve this 2nd EGM,get the grass root,divisional chairmans and their CDs to clearify their stand(call off 2nd EGM). OTK + CSL 's supporters can easily came up to 70 to 75%...the point is ,OTK solve one problem, this GANGS will create another, and another problems...never ending...chop WKS,kiv other brutus,try harder in getting back LTL, and give them a hard time.

The Malacca Baby Face MNZ initiates EGM II to call 2400 CDs to MCA Hq to attend 4M ( MAKAN ,MINUM , MAIN , MARIAH )and want to ask 3rd party to settle bills or donation from members , public , 2 big snakes or boss Tiong ? From Public - need Police Licence ( 14 days to apply ) , From members - who care , from 2 big snakes - MACC watching , from boss Tiong - staff surely oppose ( Pay Gaji first ). This Malacca Guy like LKS ( NATO ) - SMART TO TALK . MCA supporters should advise boss of restaurants , hotels or motels think twice before to take order from these Brutus Gang. The EGM 1128 with 1/3 CCM supportives but delivery an contracdict agenda which against the party constitution and VERY INSISTANCE to call for the meeting even it comes out with nothing. This can be confirm the 1/3 CCM making use of this opportunity to bribe the CDs under their hidden agenda by means of spending more than million of dollars. All units should take note of these 1/3 CCM , 2 big snakes and boss Tiong which any of their action will detriment to the interest of chinese in future.

The Party's Constitution has quite a number of Articles which are ambiguous which need to be amended. The Legal Bureau of the party should have taken the initiative to advice the party pertaining to the said Articles so that unscrupulous members do no take advantages of them. Some of them are defective and could make a mockery out of the party. Sub Article 30.2 should be amended to avoid EGMs being called to satisfied some unjustifiable selfish ends. ( if requisitioned in writing by at least one-third of the members of the Central Committee and endorsed by 2/3 of the members of the Central Committee during the CC meeting )The constitution has the noble function to protect the party and its members thus its Rules or Articles ought to be formulated in such a way that EGM is the last avenue to solve any party problem.

At the material time when the requisition was handed in, the requirement of 1/3 requisitionists was fulfilled. From the point of fact at the material time when the requisition was executed and the notice sent out the number of requisitionists was reduced to only 12. From the point of law, it contravenes Sub Article 30.2 of the constitution. The onus is on the MCA Legal Bureau to interpret the Article. Refer to Rule 174 of the Constitution. I may be wrong but in legal issue we have to be persistent and argue like a "loya buruk".

ReplyDeleteSdr Justice4otk has been with OTK since the Team A Team B fight . He has never supported the likes of LLS , OKT and CKC . He is just an ordinary , low profile ( hiding behind this blog ) person who has never benefited anything from MCA from his loyal 26 years of being a life member .
