Jan 29 for Tian Chua’s cop-biting case appeal

KUALA LUMPUR, Dec 4 — The High Court has set Jan 29 to mention an appeal by PKR Batu MP Chua Tian Chang against his conviction for biting a policeman as the magistrate’s court has yet to give the notes of proceeding and grounds of judgment.
The 46 year-old was sentenced to a six-month jail term and a fine of RM3,000 for biting the ear of policeman Rosyaidi Anuar during a protest organised by polls reform group Bersih in front of Parliament two years ago.
Chua, who is PKR strategic director, faces the possibility of losing his parliamentary seat as the fine exceeds RM2,000. A stay of execution was granted today pending appeal. Sure , 100 percent will lose his appeal .
Should he lose his appeal, the country is set to stage the 10th by-election since Election 2008, and the first to be held in the country’s capital city.
The Batu MP was charged under section 332 of the Penal Code and could have been jailed up to three years.
Chua’s lawyer Amer Hamzah Arshad told The Malaysian Insider that the documents are necessary before the court can proceed with the appeal.
“We have yet to receive the notes of proceeding and the grounds of judgment from the magistrate’s court. We need those documents so that we can prepare the filing of the petition of appeal. In the Criminal Procedure Code, before we can proceed with the appeal the appellant must file in their petition of appeal.
“The petition of appeal will consist of the grounds of why you are appealing. Before you can file the petition, the law requires the notes of proceedings as well the grounds of judgment to be supplied to the appellant which the court has yet to supply,” he said.
He added that the court should expedite the process.
“I think this is just a delay. I think the reason why they called it up is because they just wanted to see the status of matter and whether the matter is moving. The CJ (Chief Justice) has been talking about KPI so they should expedite the notes of procedures and the grounds of judgment,” he said.
He also confirmed the petition of appeal will be filed within 10 days of receiving the documents.
After going to the wrong court in Putrajaya, Chua arrived an hour later at the Kuala Lumpur High Court and told reporters that he was confident that he will be able to serve the people despite the court case.
“We expect another long series of trials as January will be when a lot of us will be under trial. There will be my appeal, Anwar’s case and other Reformasi cases. So we will see an indication of how the authorities will use court cases to drag members of Parliament into a long legal battle.
“There is also a possibility that the regime is trying to use the court to curtail the momentum of the opposition. I don’t think this will work because we will still gather support from the people and court case is not going to distract us from our work,” Chua explained.

Tian Chuan may be a crazy guy. But he is anytime better than Liow Tiong Lai, Wee Ka Siong or Chew Mei Fun. So why complained. Keep to MCA trouble lah.
