Jet engines theft: Pakatan urges gov't to probe torture allegations

Pakatan Rakyat leaders urged the government to investigate allegations that military intelligence officers had used torture to try and extract a false confession from former RMAF sergeant N Tharmendran, one of two men accused of stealing two F-5E engines from an air-base in 2007.

“There was always something odd about how only a low-ranking staff like Tharmendran can be involved without other senior officers knowing about it,” Subang MP Sivarasa Rasaiah told Malaysia Chronicle.

“It is sad to keep hearing tales of such abuses of power, but the culture of impunity has taken root in the government and permeated through all the institutions, like the police, the MACC and so on. They are supposed to protect people but end up bullying and endangering them instead. The perpetrators have a false belief that they will never be caught or brought to punishment for their wrongdoing.”

Back to the wall, the 42-year old Tharmendran had told the press of how his interrogators – two officers with the rank of Major - had made tortured him, making him wear a crash helmet and then repeatedly hit him as hard as possible.

“They used a golf stick and something long like a cricket bat. The reason is that when you hit me with a helmet (on), there's no mark. You can't find any mark, but the pain is internal pain,” he was reported as telling Malaysiakini.

“That's what Major (name withheld) told me. (He said) 'I can hit you how hard I want, but there won't be any mark. Even (if) you go to the doctor he will say you only have (a) headache'.'”

Scapegoats for the top brass?

Tharmendran was charged along with a businessman Rajandran Prasad Kusy for the theft of the engines from the Subang air force base. If found guilty, he faces up to 10 years in jail and whipping. He is now out on bail after the court finally agreed to reduce the amount from RM150,000 to RM50,000.

The high amount of bail had earlier sparked uproar and public accusations that the prosecutors were trying to keep Tharmendran in detention to prevent him from telling his side of the story.

Indeed at the height of the scandal, military top brass including a general were suspected of being involved, while Tharmendran and Rajandran were perceived to be their scapegoats.

Speculation was also rife, especially within the diplomatic circles, that the jet engines were not stolen but sold by people in authority to Iran. The sale was now being dressed up as a theft in order not to anger the United States.

“The real story has not emerged yet. These are just the puppets, the small fry. What everyone still wants to know is who master-minded the theft and was it really a theft,” Dr Syed Azman Syed Ahmad, head of PAS international bureau, told Malaysia Chronicle.

Navy chief: Sub report misleading

KUALA LUMPUR: The Royal Malaysian Navy (RMN) yesterday strongly denied media reports that the country's first submarine, KD Tunku Abdul Rahman (KD TAR), had been rendered unfit to dive because of major defects.


Calling the reports "irresponsible", RMN chief Admiral Tan Sri Abdul Aziz Jaafar lambasted a local English daily for its inaccuracies which tarnished the navy's reputation.

"The RMN regrets that these reports have been highly inaccurate and misleading, resulting in the public being grossly misinformed of the actual status of the KD TAR."

Aziz said no submarine-operating country in the world discussed the operational status of its submarines, which were deemed highly sensitive strategic weapons, in the media.


"It is disheartening to note that the writer had not acted responsibly to make any effort to verify the facts before publishing them.

"Repeatedly publishing erroneous and misleading reports will not only tarnish the image of the RMN's submarine force but also expose the country's defence establishment to ridicule.

"As such, the RMN has reluctantly been forced to rebut publicly the irresponsible misinformation and statements made in the said mentioned articles, particularly two reports which highlighted purported defects to the submarine which made it unable to dive," he said in reference to news reports by the daily in February and last week.

Aziz clarified that prior to arriving safely in Kota Kinabalu on Sept 17 last year, KD TAR had sailed approximately 8,300 nautical miles with 31 days submerged out of the 43 days spent at sea.

As such, Aziz said, the question of "Initial Operational Capability" or being "declared fully operational" did not arise as the submarine would not have completed the journey safely if it was not fully operational.

"At no point in time from the date of physical hand-over has the safety of either submarines and its crew been compromised by any defects on board.

"A submarine is constantly subjected to, and operates in, an extremely hostile and harsh environment which necessitates constant monitoring, maintenance and rectification of the systems and equipment onboard.

"Inadvertently, as in any submarine in the world, some equipment or systems can and will fail or be degraded in performance.

"The KD TAR did encounter some defects and shortcomings but at no time did any of these defects endanger the crew or submarine to the extent of rendering it unable to dive, as claimed by the news reports."

Aziz said the RMN had conducted rigorous safety inspection, appraisal and verification process, similar or even more stringent to that of aircraft safety processes, to certify a submarine "safe-to-dive" before it was allowed to embark on any mission.

"Similar to an aircraft, any submarine will have to undergo compulsory scheduled maintenance after a specified period of operations.

"These scheduled maintenance periods have been planned in advance to fit into the operational cycle of the submarines. The KD TAR has undergone, as scheduled, several of those maintenance periods since returning to Malaysia.

"Thus, the news report in February that KD TAR suffered a technical defect that prevented it from diving for three months is untrue as the KD TAR had in fact been undergoing its scheduled maintenance period during that period."

Aziz also criticised the part of the article which said the submarine had been lying unfixed in the naval base, saying it conjured up an image of the submarine lying idle at the naval base, crippled and unattended to.

"The fact is that the submarines, like all RMN surface ships, are manned 24 hours a day, every day and all defects, however small or insignificant are acted on immediately.

"However, in this case the statement is untrue as the KD TAR has in fact been operational, a fact that the armed forces chief (General Tan Sri Azizan Ariffin) can attest to when he dived with the submarine during her operations in the South China Sea on March 5-8.

"Lately, the submarine had also successfully carried out a test firing of a mock-up missile during operations in the South China Sea."

Aziz added that the question of the the crew losing their submariners rating if they remained on land as claimed by the report did not arise.

"However, in the unlikely event that the submarine is indeed rendered unoperational for an extended period, the crew will still be able to maintain currency (as submariners) via simulator training which is available at the Submarine Training Centre at the submarine base (in Teluk Sepanggar)."

The RMN, he added, also viewed very seriously the fact that "defence industry sources" had divulged, albeit erroneously, information that were highly classified to the media.

"The RMN will initiate a thorough investigation to identify these sources, as these irresponsible elements can also be divulging information to other unauthorised parties," he said, adding that the Official Secrets Act could be invoked on the culprits.

Scorpene Sub ‘Tun Razak’ Arriving in Lumut on July 2

KUALA LUMPUR: The country’s second Scorpene submarine, KD Tun Razak, is heading for a momentous homecoming at the Royal Malaysian Navy base in Lumut on July 2.

The sultans of Perak and Selangor, Sultan Azlan Shah and Sultan Sharafuddin Idris Shah, are expected to grace the ceremony along with Defence Minister Datuk Seri Dr Ahmad Zahid Hamidi and military top brass, said a Defence Ministry spokesman. The Sultan of Selangor is captain-in-chief of the RMN.

It is understood KD Tun Razak is presently in the Indian Ocean after departing from Toulon in France on April 30 following successful sea trials in the Mediterranean. The country’s first submarine, KD Tunku Abdul Rahman, arrived at Port Klang on Sept 3 last year.

It has since become operational after overcoming minor hitches during tropical water trials in Malaysian waters.

Both SSK diesel-electric powered submarines of the Perdana Menteri-class will operate out of their main base — Teluk Sepanggar in Sabah. More than 150 RMN submariners were initially trained at Brest, France, to man the two submarines. Once here, KD Tun Razak, commissioned into the RMN at Cartagena, Spain in November last year, will undergo tropical water and operational trials.

Both the SSK submarines and an Agosta-class second-hand vessel boat were procured following an agreement with DCNS and its partner Navantia under a RM3.4 billion package in June 2002. The Scorpenes were jointly built at the Navantia shipyard in Spain and DCNS facility in Cherbourg, France. Each Scorpene submarine is 67.5m long, has a displacement of 1,550 tonnes, is manned by a crew of 31 and can sail for 45 days.

Stolen jet engines found

The missing engines were discovered in Uruguay.

KUALA LUMPUR, Feb 5 — Tan Sri Abdul Gani Patail has tonight confirmed that the stolen F-5E engines have been located in Uruguay.

The attorney-general, in a statement, said the engines were discovered in the South American country following co-operation from the authorities there.

Expressing his gratitude over the assistance rendered by the Uruguayan officials in helping bring an end to the case of the stolen engines, Gani said that the two countries will continue to work closely to enable the return of the engines to Malaysia.

The two F-5E jet engines were stolen in 2007 and discovered missing one year later, before a police report was lodged.

RMAF Sergeant N. Tharmendran and company director Rajandran Prasad were charged early this month in connection with the theft.

Malaysia bought 14 F-5Es in 1974 and decommissioned them in 1999. One crashed in the Malacca Straits near Perak on May 31, 1995.

Only six of the jets remain operational after they came back to service in 2003.

PETALING JAYA - A Royal Malaysian Air Force (RMAF) sergeant, N Tharmendran, 42, and a company director Rajandran Prasad Kusy, 38, were today charged in the Petaling Jaya Sessions Court in connection with the two missing RMAF F-5E jet engines.

Tharmendran was charged with theft and abetting in the crime while Rajandran faces a charge under section 414 of the Penal Code which is dishonestly receiving and disposing stolen property.

They were also charged with conspiring to steal the engines.

Not guilty plea

Both Tharmendran and Rajandran claimed trial before Sessions judge Aslam Zainuddin.

Tharmendran was represented by V Ravichandran while Pritam Singh Doal appeared for Rajandran.

Aslam fixed a bail amount of RM150,000 each for both Tharmendran and Rajandran. The case will be heard jointly on Feb 11.

'Only scrap metal'

Meanwhile lawyer for Rajandran, Pritam Singh told The Malaysian Mirror ,"The media and the US government have said that the case involves terrorism. This is all not true. We stolen-jet-case-1should base this on information before we comment further."

He also claimed that the US government was "accusing the ruling government by saying we have gone to countries that have been sanctioned by them (US)."

"Even politicians say that items being lost in the armed forces are becoming a joke. Anything can happen down there. Don't accuse them (the two being charged) of being involved in terrorism.

The press have to be careful. This is only scrap metal. We're talking about scrap. Besi buruk. This is actually a case involving a besi buruk.

"In high-tech terms, this is a second-hand machine, that's all. So they need not blow it out of proportion by saying it is a fully functioning jet. This is a non-functioning jet part, an engine," Pritam claimed.

Mitigation

In mitigation, Pritam Singh told the court that Rajandran's properties were frozen by the authorities and his passport has been confiscated.

The jets engines were found missing in 2007 while being taken for a routine maintenance from the 12th Squadron (Scorpion) in Butterworth to the RMAF storage facility in Kuala Lumpur.

The jet engines were discovered stolen by RMAF on May 22, 2008 and a police report was lodged on Aug 4 the same year. - Malaysian Mirror

RM50 million Engines ?

On missing jet engines: Are they not of public concern and injustice to corrupt away taxpayers' money> Why this issue is said to be not very important to MCA. It is really ridiculous. So what can MCA do if it can't do little thingshow can it perform slighly bigger thing. Pleae humble up?

As I mention earlier it seems there's one particular anon who likes to bring up issues of no importance to MCA . I didn't want to waste my time answering him but I like to post this to show his shallow thinking and trying to make a mountain out of a molehill just like all DAP or PKR cybertroopers who cling and inhibit onto certain blogs like parasites hoping to suck the host dry .

Public concern ? oh yes every criminal act is of public concern . The military brass , the police and the defence ministry is leaving no quarters untutrn to find out who the culprits are . Need the MCA get involved ? I don't so since its Minister is not from the MCA .

Corrupt away taxpayers money ? Looks like this joker can't differentiate between corruption and stealing . This is a very clear cut case of stealing obsolete military hardware for sale and making a fast buck out of it .

The planes have been in service since 1972 and were in the midst of being phased out and replace by more advance fighter planes .

F-5E/F TIGER II as Interim Fighter

The F-5E "Tiger II" was a greatly improved version of the earlier F-5A "Freedom Fighter". Redesigned as a highly maneuverable, lightweight and inexpensive air superiority fighter, the -E featured an air-to-air fire control radar system and a lead computing gunsight. More powerful J85 engines required the fuselage to be both widened and lengthened. The forward wing root was redesigned to give the "Tiger II" wing its characteristic triple delta shape.

The first flight of the F-5E was on 11 August 1972. The first USAF unit to receive the aircraft was the 425th TFS at Williams AFB, Arizona responsible for training foreign pilots in the F-5 aircraft.

A total of 1,166 F-5E , 241 F-5F and 12 RF-5E were produced by Northrop and under license in Switzerland, South Korea and Taiwan.

A number of companies offer upgrade packages for the F-5. The packages are popular because of the aircraft's sound design and widespread use, and will ensure that the type will serve for many more years.

Chile's F-5 fleet was upgraded by IAI of Israel to F-5E Plus Tiger III standard. New systems include the Elta EL/M-2032 multi-mode, pulse-Doppler fire control radar developed for the Lavi, HOTAS controls, a new El-Op HUD, MIL-STD-1553 digital databus and air data computer, radar warning receivers for 360 degree coverage, active jammers, flare and chaff dispensers and provisions for Python-3 AAMS and laser guided weapons.

The IAI/Lahav Division also leads the consortium comprising Elbit Systems and Singapore Aerospace Technologies currently undertaking the modernization of 48 F-5s of the Turkish Air Force. The program, worth $75 million, involves avionics systems upgrades covering weapon, navigation and cockpit system upgrades, as well as airframe structural life extension and reinforcement. Turkey expects to use its F-5s until 2020 as their intermediate Aircraft for training new pilots before they move up into F-16s.

Taiwan and Bahrain are also contemplating adding provisions for the AIM-120 AMRAAM missile to their F-5s.

Many surplus F-5E/Fs are currently available.

Switzerland was in the process of retiring 16 F-5Es, with 9 of them going to a technical school as instructional airframes, the rest were to be sold back to the United States to replace older F-5s used in the agressor role in dissimilar aircraft combat training. Most US Navy agressors have flown over 7,000 hours but Swiss aircraft have yet to reach 3,000 hours (Air Forces Monthly, March 2000).

The Philippines was studying the possibility of acquiring surplus F-5E/Fs from Saudi Arabia, which is replacing the type with F-15s. Taiwan was reported to have offered the Philippines F-5s at a low price of $1 million each, although this was earlier denied by officials in Taiwan, which received a total of 306 F-5E/Fs from the US or from AIDC. More recent statements by US Congressman Dana Rohrbacher and the Philippine government confirmed that negotiations are underway for the transfer of up to 24 Taiwanese F-5E/Fs. Sources have said the deal involves payment of a token fee, a state visit by the Taiwanese head-of-state, fishing rights to the channel between Taiwan and Batanes, and the use of facilities at the former US Clark Airbase for training purposes. While the aircraft are badly needed the political implications of the conditions may make the deal unworkable. The Philippines had previously received several F-86 fighters from Taiwan before adopting its "one China" policy. The current handful of F-5As operated by the PAF were sold to the Philippines by South Korea for the "friendship" price of US$100 each in recognition of the Philippine's role in the Korean War.

If the aircraft can be offered to the Phillipines for a price tag of US$1 million each by Taiwan , how could the engines be sold for RM$50 million each when the aircraft was due to be scraped and sold at scrape price ? Perhaps Anon who seems to be harping on this issue can tell me and everyone here ? I really think he only knows how to blah , blah , blah without any research on the issue . Typical of Opposition idiots .
