Investigation Papers on Soi Lek's sex video to be sent to AG

KUALA LUMPUR - The investigation papers on the distribution of the sex video involving MCA President Datuk Seri Dr Chua Soi Lek will be submitted to the Attorney-General's Chambers soon.

Home Minister Datuk Seri Hishammuddin Tun Hussein said Dr Chua lodged a police report after being informed by a colleague on the distribution of envelopes containing two DVDs in several areas in Batu Pahat, Johor, which was intended to smear his image.

Following the report, police conducted an investigation and the investigation papers submitted to the Attorney-General's Chambers, before the Attorney-General ordered for further investigation, he said in a written reply to a question by Hee Loy Sian (PKR-Petaling Jaya Selatan) in Parliament Tuesday.

Hee wanted to know the rationale Dr Chua was not charged in court.

Hishammuddin said the case was investigated under Section 292/509 of the Penal Code.

In January 2008, Dr Chua resigned from his cabinet post and as MCA vice-president after admitting that the man in the sex video was him.

Amid speculation the MCA's internal elections due next year might be postponed especially if snap general elections are called by Prime Minister Najib Razak, party president Chua Soi Lek insists the MCA's triennial elections will be carried out as scheduled.

However, Soi Lek did not reiterate his previous promise that he would surrender the presidency - an assurance he had given during the MCA's special elections held earlier this year following a no-confidence vote against his predecessor Ong Tee Keat.

“The party election will be due early next year, and by then it would only be 36 months from the March 8, 2008 general election and I don’t see why we should postpone our election,” the Star reported him as saying.

Under MCA's constitution, elections for the national leadership takes place every three years. The last party election was on October 18, 2008. However, due to a massive internal power struggle between factions loyal to Soi Lek and Tee Keat, extraordinary general meetings were held in 2009 and a special vote conducted earlie this year.

Soi Lek beat Tee Keat for the presidency but vowed he would only hold the post for a year and not contest when the triennial-election proper fell due in 2011.

Indeed, speculation has been rife that he may wish to cling to power and pundits had expected that he may use the excuse of a full-blown general election to renege on his word. However, he denied he would.

“If everybody loves the party, we can fight for positions without having to throw chairs, ballot papers or complain of missing names in the delegate list,” Soi Lek said.

No direct elections

Soi Lek also dismissed calls from grassroots for the MCA to hold direct elections soon, whereby each member would be able to vote directly for himself or herself the leader of his or her choice.

Currently, despite having nearly a million members, only 2,400-odd delegates are given the power to vote on behalf of their divisions - giving room for manipulation and corruption.

“Nobody wants direct elections next year. We need to amend the party constitution before it can be carried out. The entire process of amending the constitution, which includes calling an EGM (extraordinary general meeting) to approve the amendments and going to the ROS (registrar of societies) before it can be implemented, will take at least six to eight months,” said Soi Lek.

According to Soi Lek, the MCA's first priority was to close ranks and unite as a party so that it could regain the seats it lost in the next general election. The biggest challenge for MCA was to regain the confidence of the Chinese electorate, he said.

“Everyone said we should spend our time and resources on the general election. Direct elections in the party is meaningless if MCA loses in the general election. Your party position will be a burden to you if MCA lost many seats in the next general election,” he said.

MCA begins its elections at the branch level, usually around March, before proceeding to the division and national levels, and the entire process takes about four months. Its Youth and Wanita wings also have elections in the same year.

MCA president Chua Soi Lek has fallen deeper into a hole of his own making. It looks like the final curtains will really fall on his party, which has been struggling with little success to regain the confidence of the Chinese community.

In his haste to curry favor with Umno, Soi Lek has now destroyed the last vestiges of self-respect that the community may still feel for the MCA.

Instead of insisting on change for a plural and equal society, the 63-year old Soi Lek stunned the nation on Tuesday when he insisted that Umno leaders had never sought Ketuanan Melayu or Malay supremacy.

Unsurprisingly, he drew a storm of flak – not just from Chinese leaders but also from prominent Malays, disgusted and alarmed at the growing racism and religious bigotry in the country despite 53 years of nation-building.

“This is utter denial syndrome from Chua Soi Lek. Not only will it make the non-Malays despise him and MCA more, it will increase the contempt the Malays already feel for him. He makes the MCA appear to be running dogs - and for this, he should be sacked,” Bukit Gantang MP Nizar Jamaluddin told Malaysia Chronicle.

“Let me as a Malay correct this lie put forward by Soi Lek. Let me tell all my fellow Malaysians - Umno not only preaches Malay supremacy, they live and die for it. Not for patriotism or nationalism but because this is the only way for the Umno elite to cling to power, to keep enriching themselves. But by helping Umno to perpetuate this smoke screen, Soi Lek is an accessory to the grand larceny taking place. He is not helping Malaysia, he is helping to destroy her.”

The MCA leader had flown to the defense of Umno, who had been accused by Singapore’s Minister Mentor Lee Kuan Yew, of practicing race-based policies that kept the country and its people backwards.

This is not the first time that Kuan Yew has accused Umno of such bigotry. In fact, he has crossed swords many times with various Umno leaders especially with former prime minister Mahathir Mohamad.

“Malaysians saw it as a Malay country, all others are lodgers, “orang tumpangan”, and they the Bumiputras, sons of the soil, run the show. So the Sultans, the Chief Justice and judges, generals, police commissioner, the whole hierarchy is Malay," Kuan Yew had said in an interview earlier this month..

"All the big contracts for Malays. Malay is the language of the schools although it does not get them into modern knowledge. So the Chinese build and find their own independent schools to teach Chinese, the Tamils create their own Tamil schools, which do not get them jobs. It’s a most unhappy situation."

But when asked to respond to Kuan Yew’s comments, Soi Lek came out with his by-now classic reply.

“In my association or the MCA’s association with Umno, I have never heard of any Umno leader who says that the Malays are more superior than the non-Malays. No,” he told reporters.

Ulterior motive

Since winning the MCA presidency earlier this year on a wave of sympathy votes after he was forced to quit the government following a sex scandal, Soi Lek has fallen into one scrape after another.

Not only did he incur disdain when he snatched a deputy minister’s post for his son, Chua Tee Yong, his hand-picked secretary-general Kong Cho Ha immediately ended a high-profile investigation into the RM12.5 billion Port Klang Free Zone financial debacle initiated by his predecessor Ong Tee Keat.

Speculation is now rife within MCA circles that he is angling for Umno support in next year’s party elections although he has promised he will only be president for one year.

“If Umno does not practice Malay supremacy, then Chua Soi Lek must be living in another country. He should also ask Dr Mahathir Mohamad if it is true there is no such thing as Malay supremacy and that according to Umno all the races are equal in this country,” Taiping MP Nga Kor Ming told Malaysia Chronicle.

He should ask Dr Mahathir and Prime Minister Najib to openly declare this stand, then only make this such a statement. Otherwise, he is just lying to the people, not just the Chinese but all the Malaysians. This is his own low standard and by reflection MCA’s low standard.”

KUALA LUMPUR (Malaysian Insider) - With Umno now openly snubbing Perkasa, MCA appears to have made amends with its Barisan Nasional (BN) ally, claiming that not one of the Malay party’s leaders had ever preached the superiority of the country’s dominant race.

MCA president Datuk Seri Dr Chua Soi Lek put aside his recent disagreement with Umno leaders by reaffirming today his loyalty to the alliance with the country’s largest Malay party.

“In my association or the MCA’s association with Umno, I have never heard of any Umno leader who says that the Malays are more superior than the non-Malays. No,” he firmly said in a press conference after chairing a meeting with several Chinese associations at Wisma MCA here this afternoon.

Dr Chua’s statement was in response to Singapore Minister Mentor Lee Kuan Yew’s remarks during a recent interview with the New York Times on state of Malaysia’s race relations, which he described as “a most unhappy situation”.

“We respect the view of Lee Kuan Yew. He is entitled to say... he is a very senior statesman,” he said.

But Dr Chua agreed that Malaysia’s race relations were less than ideal and stressed that this was largely becaue of the intense competition between the political parties post-Elections 2008.

“There is intense competition between all the political parties in order to gain support.... and in a multi-racial country like Malaysia, race would be a very easy issue to be used for support,” he said.

Dr Chua however disagreed with the notion that this was caused by constant harping on the superiority of the Malay race by Malay leaders.

“I don’t think it is fair to say Malay leaders always harp on the fact that the Malay race is superior. I don’t think so.

“I think they are only the minorities of the minorities who harp that the Malays are superior. This is the tactic of the opposition to make Umno look bad,” he claimed.

Dr Chua claimed that in its 53-year rule, the BN had proven its worth in managing the complexity of race relationships.

“What we do here is that because the Malays are Bumiputeras and economically, they are not on par with the other non-Malays and they continue to require affirmative action... and that is the reason why we say affirmative action should be based on needs and merits.

“If it is based on needs and merits, then if the Malays are poor either economically or are academically backward, then they can still continue to receive help from the government.... because they are poor,” he stressed.

Dr Chua also indirectly disagreed with former prime minister Tun Dr Mahathir Mohamad’s apparent continuing defence of Perkasa, and said that the views of the country’s current Prime Minister Datuk Seri Najib Razak should take precedence above everyone else’s.

“I think in a democratic country, people are entitled to their own opinion. In no country that practices democracy, 100 per cent of their people talk in the same tune.

“Dr Mahathir is also an elder statesmen... we respect his view, he is entitled to his views (but) I could hold on more to the views of the current Prime Minister. I would say it has greater relevance to us because he is the number one in the country,” he said.

The Malaysian Insider understands that the Prime Minister had instructed his leaders to distance themselves from Perkasa, fearing that any association with the controversial Malay rights group would only cause BN to lose more support.

Dr Mahathir, who is Perkasa’s patron, however stepped in to warn Umno against snubbing Perkasa, claiming it would only cause them bigger electoral losses in the next election.

The newly formed non-governmental organisation has been making waves in the country’s political landscape and has even succeeded in pitting Umno and MCA against one another.

In Dr Chua’s recent war with Umno leaders, Perkasa played a role in fanning the fires when he slammed the Chinese-based party for fighting to abolish the 30 per cent Bumiputera equity target.

In response, top Umno leaders like its deputy president Tan Sri Muhyiddin Yassin and vice-president Datuk Seri Hishammuddin Hussein stepped in to remind MCA not to forget the BN’s struggles when fighting for the rights of the Chinese community.

MCA has also been the only BN party so far to strongly oppose Perkasa’s oftentimes extreme views.

When Umno began disassociating itself from the group, MCA jumped in quickly to laud the move.

Dr Chua also voiced hope today that despite the current spate of racially-charged political tiffs, the country would one day improve on race relations under the BN.

“I do not think we are a perfect government. We have our defects and deficiencies... this is to be expected because if you are in power for 53 years and you have no problems, then something must be wrong somewhere,” he said.

He pointed out that under a mere two and a half years in government, the Pakatan Rakyat coalition has already shown its weaknesses.

“If you look at Penang... I do not think they have done a good job. They have street protests by certain ethnic groups against the state government.

“In the same way, if you look at Selangor, you have the issue of the support letters affecting one particular race and one particular party,” he said.

If Malaysian Chinese held hopes the MCA could help broker a new politics for the country that tore through racial lines, then they will be sadly disappointed. MCA president Chua Soi Lek not only admitted racial tensions were rising in Malaysia, but refused to acknowledge it was due to the divide-and-rule policies promoted by the ruling BN coalition, insisting that race politics would always be the name of the game.

“It confirms what the Chinese community has been saying about him since he became president. He’s a running dog for Umno and can never take MCA or the Chinese community to new heights,” PKR vice president Lee Boon Chye told Malaysia Chronicle.

“He has promised to stay as president for only one year. MCA members better make sure he doesn’t change his mind because one year with him is already one year wasted. A good leader could have done so much more to help improve race relations in the country. But instead of trying, he has already made up his mind it can never happen. Why? Is it to curry favor with Umno so he can stay on when his year is up?”

Indeed the 63-year Soi Lek has only become more unpopular after public sympathy over his sex scandal helped him to wrest the MCA presidency from Ong Tee Keat earlier this year. But initial rumblings that Soi Lek was aligned to the right-wing Umno faction controlled by former premier Mahathir Mohamad and Deputy Prime Minister Muhyiddin Yassan have now gained credence especially as he positions himself against the multi-racialism desired by the great majority of Malaysian Chinese.

He has tried to show MCA’s independence from Umno, the dominating partner in the BN coalition, by calling for an end to the 30 percent Malay and Bumiputera corporate equity target. But he quickly retreated after Muhyiddin and other ultra-Malay rights leaders like Ibrahim Ali bombarded him with threats and warnings not to challenge their status.

Soi Lek got into another scrape when he tried to turn the Chinese community against PAS, the Islamic-based party in the Pakatan Rakyat coalition, but again had to U-turn after prominent Muslim leaders in the country took him to task for what they said was his religious ignorance and bigotry.

The MCA president also failed a major test when he refused to speak up for controversial rapper Namewee, whom Umno leaders had wanted to prosecute for a three-minute video clip made to protest the allegedly racist behavior of two Malay school principals. The two teachers had apparently told their Chinese pupils to go back to China and one of them likened the Indians to dogs.

In an interview with the Singapore Straits Times, Soi Lek said the emergence of a strong political opposition in Malaysia had failed to reduce racial sentiments. He also accused the Pakatan parties of being as race-based as the BN.

“Whoever comes to power, whether it’s BN or PR, it’s a game of balancing, of managing the expectations, needs and fears of all the races. And this is not an easy game,” Soi Lek had said.

Pundits however point out that racial tensions rose in Malaysia not because of the Pakatan, but due to 53-years of built-up communal politics promulgated by the BN. In particular, Umno has been accused of stirring hatred in the Malays for the minorities especially the Chinese.

In the courses run by the BN's National Civics Bureau, it has been revealed that university graduates and civil servants were taught that Chinese are like Jews – the traditional enemy of the Muslims.

Yet Soi Lek made no mention of these factors, opting to pin his views on baser human instincts rather than call for a concerted national effort to blur racial lines. Such a call would surely get him into trouble with Umno, which promotes a Malay supremacy policy.

“He is a bogus and insincere leader. Malaysians especially Malaysian Chinese must ask why they should ever vote for him since he cannot even fulfill the basic requirements of nation-building,” PKR strategic director Tian Chua told Malaysia Chronicle.

PUTRAJAYA, Sept 10 — Barisan Nasional leaders finally came together today in an apparent face-off with Malay rights group Perkasa and its controversial president Datuk Ibrahim Ali, who has been seen as a thorn in the side of the Najib administration.

Umno’s top leaders, who have kept silent so far on the topic of Perkasa, dropped their defences when approached on the matter today and while they remained cautious, they agreed that supporting the controversial group’s views could prove detrimental to BN’s struggle.

Leading the fray was Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz, who told The Malaysian Insider that it was “about time” that Umno made a strong stand against Ibrahim and the fledgling Perkasa.

“I have said this much earlier — Umno should have come out much earlier. Only now they are echoing my views.

“But it is good, yes, it will help us in our struggle because to disassociate ourselves from groups like this is very important.

“Perkasa is very much against our 1 Malaysia policy,” he said when approached at Prime Minister Datuk Seri Najib Razak’s Seri Perdana residence here for his Hari Raya open house.

Nazri, who has been the most vocal of all Umno leaders on the topic of Perkasa, even went a step further to assert that all of Perkasa’s members from Umno and its patron, former premier Tun Dr Mahathir Mohamad, were political “has-beens”.

“Who are they? Has-beens. They are people who failed to get positions in the party so they run to Perkasa.

And Dr Mahathir? Has-been,” he said.

In a statement to an English news daily front-paged yesterday, Umno secretary-general Datuk Seri Tengku Adnan Tengku Mansor said he had told his counterparts in all BN parties that Umno would not back Perkasa or its president Ibrahim in the next general election.

The leader reportedly admitted that any move to support Perkasa would only erode BN’s support from the non-Malays.

Speaking to The Malaysian Insider, Tengku Adnan even said that Umno would field its own candidate in Ibrahim’s Pasir Mas constituency in the next election.

He also said that BN leaders agreed that distancing themselves from Perkasa was the best way forward, acknowledging that Perkasa had successfully pitted BN component parties against one another.

Higher Education Minister Datuk Seri Mohamed Khaled Nordin agreed that Perkasa’s views were lopsided, saying that Umno never subscribed to the group’s ideals.

“In Umno, when defending the rights of the Malays, we try to be fair.

“What Perkasa is doing is that when they bring up something, it is perceived that they fail to take consideration or interest in other races. Umno does not subscribe to what Perkasa is doing,” he told The Malaysian Insider.

He reminded Ibrahim that the nation was bound together by its diversity and lived in harmony because of the understanding and social arrangement already agreed upon in the past.

“If we upset the equilibrium, surely that will cause an upset.

“That is why in Umno, we defend Malay rights but we believe there is a place for all Malaysians. We want all groups to understand this part,” he said.

Defence Minister Datuk Seri Dr Ahmad Zahid Hamidi further distanced Umno from Perkasa, pointing out that the group’s struggles were very “ethnocentric” in nature.

“We should reject ethnocentricity in this country. It should not be encouraged.

“I am worried that other groups will start fighting for their own ethnic needs,” he said.

He pointed out that Umno may belong to the Malays and the Bumiputeras but it still fought for the rights of the non-Malays.

Deputy Minister in the Prime Minister’s Department Datuk Ahmad Maslan echoed Zahid’s views, pointing out that Perkasa’s fight was for the rights of one single race.

“We fight for all. Umno’s struggles are by far bigger than Perkasa’s struggles.

“Umno fights for the Malays and for the country and the international stage. Perkasa only struggles for the Malays,” he said.

Agriculture and Agro-Based Industry minister Datuk Seri Noh Omar said Perkasa was merely an “NGO”.

“We have to be able to tell between a political party and an NGO. They should work as an NGO and that’s all. They can organise their functions and carry out their programmes as an NGO,” he said.

The Umno leaders also acknowledged that many Perkasa members were from Umno, but insisted that this was a minority.

“They do not represent all of Umno. Anyone can join an NGO,” said Khaled.

Nazri, however, insisted that these were “sunset politicians”.

“They have no impact on us. No one cares about Perkasa. They are only famous in the media,” he said.

He predicted that should Ibrahim recontest his Pasir Mas parliamentary seat in the next elections, he would lose.

“Because he cheated PAS and won on a PAS ticket. But who will support him now as an independent?” he said.

Deputy Federal Territories and Urban Well-being Minister Datuk M. Saravanan also joined his BN colleagues in rejecting Perkasa.

“MIC is happy that we are moving now to distance ourselves from Perkasa. They will not in any way help the BN,” he said.

Several MCA leaders also commended Tengku Adnan for calling on BN leaders to reject Perkasa.

MCA vice-president Gan Ping Sieu said that Ibrahim was a “nobody” and should be ignored.

“We should not dignify him with so many answers and replies,” he said.

Fellow vice-president Datuk Chor Chee Heung said that Tengku Adnan’s statement was the most sensible statement made by an Umno or BN leader.

MCA president Datuk Seri Dr Chua Soi Lek refused to comment on the matter. Sudah hilang bola !

However, it is understood that there is no love lost between Dr Chua and Ibrahim, who have been at each other’s throats over their differences in opinion.

M'sia at a crossroad: Immoral Soi Lek slammed over Namewee

The writing is on the wall for MCA president Chua Soi Lek and if party members are smart, they will call another of their famous EGMs and throw him out before he does more damage to their party and the Chinese community, pundits said.

Soi Lek drew unprecedented anger from the community when on Sunday he made another major gaffe by calling popular rapper Namewee vulgar and irresponsible. The torrent of rage that flooded back would have necessitated an immediate apology in many democracies but in Malaysia, where MCA has to toe the political line set by coalition boss Umno, Soi Lek is expected to get off the hook.

In fact many believe he was “under orders” to help Umno – especially the hawks led by Deputy Prime Minister Muhyiddin Yassin and former premier Mahathir Mohamad - rally Malay support against the political opposition, in particular the Islamic-based PAS.

But in their haste to chase for fading Malay popularity, the group has also stomped on Prime Minister Najib Razak’s multiracial 1Malaysia plan, underscoring the crossroad that the nation has reached and the crucial direction it must now select.

“After 53 years of independence (from British rule) and nation-building, we still have people who propagate racism. It shows there is still fertile ground in Umno where racism is flourishing,” PKR vice president Lee Boon Chye told Malaysia Chronicle.

“If Umno continues to rule Malaysia, this is the path of destruction that the nation will be pushed into. Malaysians must make a stand – is this the sort of leadership they want? Is a closed-door racist Malaysia the sort of country they want to live in because this is what will happen? Malaysia will be shunned by the world as an apartheid nation if it doesn’t come to its senses and stop the rot.”

A coward and a hypocrite

Namewee, whose full name is Wee Meng Chee, had lambasted a school principal Siti Inshah for hurling racist remarks at her non-Malay pupils. She had allegedly told the Chinese students to return to China and likened the Indian ones to dogs. Siti Inshah was not the only one, her colleague in Kedah was also said to have made similarly racist remarks a few days after her.

However, Namewee’s tape which contained the foul language of his generation of rap musicians drew the attention of a 'hungry' Umno leadership. With the help of their media, Namewee's tape was sensationalized and he was hauled up by the police to have his statement recorded on Sunday.

Meanwhile, Umno has been careful not to act against the two school principals, both of whom are Malay. The predominantly Malay teaching community is one of the party’s traditional electorate and Umno leaders do not want to offend it.

“Vulgar not, it is pop music and a lot of it is subjective. Many parents may not like and it should be considered X-rated or PG material but it is not seditious. Now, that is political. Why should the state take such heavy-handed action against Namewee and what is the reason for the double-standards in not going after the principals,” Batu MP Tian Chua told Malaysia Chronicle.

“As for Chua Soi lek, it shows him to be the coward and hypocrite that he is. He dare not stand up for Namewee or insist on action to be taken against the racist headmistresses. He also doesn’t dare speak up against the Umno warlords or antagonize Muhyiddin and Mahathir. His own political survival is at stake and like the MCA presidents before him, he has resorted to pleasing the Umno bosses to keep his hold on power even though he is sacrificing the Chinese community in the process.

Indeed, the comments that have flooded cyberspace do call for an immediate evaluation of the embattled Soi Lek's tenure as head of the Malaysian Chinese Association. His sex scandal has flared up again amid renewed criticism that his immorality made him an suitable critic for Namewee. Some of the comments that typified the anger that he roused include:

In 2007, Soi Lek had to resign as Health Minister after a DVD showed him having sex with his mistress. The scenes of adultery were widely circulated around cyberspace and at one time, his foes in the BN government even considered prosecuting him for having unnatural sex with his female friend.

“Yes, nobody really wants to rake up the past. But when you try to hit someone else unfairly and just for selfish reasons, then vengeance will follow you. This is truly a case of the pot calling the kettle black,” said Boon Chye.

“Soi Lek has no moral standing to criticize Namewee. No matter how vulgar Namewee was in his expression, it cannot be worse than Soi Lek’s video. Just ask youselves, if our children listened to Namewee’s tape and then watched Soi Lek’s video, which one would be the greater negative influence.”

Soi Lek tells Namewee to ‘face the music’

KUALA LUMPUR, Aug 31 – MCA president Datuk Seri Dr Chua Soi Lek told controversial songwriter Wee Meng Chee today to “face the music” for offending other races and religious groups through his music video allegedly containing racial slurs.

Johor police denied today that they were arresting the songwriter, better known as Namewee, following his post on his Facebook page late last night that policemen in three patrol cars had come to his house in Muar to arrest him.

“Freedom of expression should come with responsibility to consider sensitivities towards other races and religions,” Dr Chua (picture) told reporters today.

“Once he (Namewee) breaks that responsibility, he has to face the music,” he added.

The MCA president pointed out that he had helped Namewee extend an apology to the government after producing a headline-grabbing music video in 2007 that purportedly ridiculed the national anthem and the Islamic call for prayer.

“The end result was that he was pardoned,” said Dr Chua.

The MCA president slammed Namewee’s use of vulgar words and rude signs in his music video.

“I saw on (You)tube his singing and lyrics. There were a lot of vulgar words and signs that should not be used at all,” said Dr Chua.

“He should not bother with vulgarities,” he added.

Namewee is under investigation for allegedly producing a seditious music video which was uploaded on video sharing site YouTube.

The video which contains racial slurs is a stinging criticism of Johor school principal Siti Inshah Mansor’s allegedly racist remarks against Chinese and Indian students.

The SMK Tunku Abdul Rahman Putra school head allegedly said during a school assembly that “Chinese students ... can return to China,” and likened the prayer strings used by Indians to dog leashes.

“If those two school heads are proven (to make racial slurs), police should also charge them,” said Dr Chua, referring to Siti Inshah and another school principal in Kedah who was accused of telling Chinese students to return to China.

“This will send a strong signal that the government should reject any form of extremism,” he added.

Education Minister Tan Sri Muhyiddin Yassin reportedly said that they were now waiting for the Public Service Department director-general’s decision on Siti Inshah, following the submission of the Education Ministry committee’s findings to him upon completing their investigations.

Namewee removed the video on Siti Inshah from Youtube following public disapproval.

The video resulted in calls for government to take stern action against Namewee, including arresting him under the Internal Security Act (ISA) and revoking his citizenship.

More troubles for Soi Lek and MCA, Liow starts sniffng around

WITH VIDEOS It looks like MCA deputy president Liow Tiong Lai is starting to buckle to pressure from Umno and Perkasa over row about the 30 percent Bumiputera equity target. Either that or he is starting to position himself to go one up on his boss Chua Soi Lek, who has borne the brunt of the Malay onslaught so far.

In the Chinese community, Liow – the Health Minister – is often called ‘fan kuat chai’ or double-crosser for his role in demanding the resignation of previous president Ong Tee Keat.

“Can a leopard change its spots? This is the problem with MCA in particular and society in general. There are too many people willing to go to all sorts of lengths just to gain power and wealth,” an MCA watcher told Malaysia Chronicle.

Same or different

Liow raised eyebrows when he said a day ago that whatever stand the MCA took, it would be different from the DAP’s, whereas Soi Lek earlier in the week had said MCA would not fear to share DAP's views if they benefited the community..

“It is not the same with DAP. DAP is different. We are different. It is never the same. We are voicing out in the spirit of BN but not DAP," NST quoted Liow as saying on Wednesday.

Said Soi Lek in a press statement on Monday: “The new MCA leadership strongly believes that its political struggle is totally reasonable and legal. MCA will not be afraid of sharing similar views with DAP in terms of the benefit of the community nor choose to run away from making a stand.”

Indeed, the hapless Soi Lek has been left reeling from the twin attacks from Perkasa and Umno's deputy president Muhyiddin Yassin.

On Wednesday, Perkasa lodged a police report against Soi Lek. But perhaps reminded by Umno that MCA was still BN's main source of Chinese votes, the ultra-Malays rights group made sure to announce that the complaint was against the MCA president and not against the party.

“Whoever who questions Malay rights will have actions taken against that person,” Perkasa secretary-general Syed Hassan Syed Ali was reported as saying.

The real root causes - racism and corruption

The brouhaha began last Saturday after Soi Lek proposed at an economic congress attended by both Prime Minister Najib Razak and his brother Nazir a gradual reduction of the 30 per cent Bumiputera quota to foster greater competition and resilience in the economy.

“MCA recognizes the noble objective of the NEP which was to eradicate poverty regardless of ethnic background. However, in echoing the words of CIMB Group CEO Datuk Nazir Razak where he said that the NEP’s ‘implementation has been hijacked by self-interest groups’, these weaknesses have to be rectified,” another MCA leader, Chor Chee Heung, had defended.

But while Soi Lek and MCA may have got their facts rights, they chose the wrong tack to regain Chinese popularity. Not only did it create a media circus with starring roles played by Umno and Perkasa, it failed to really excite the Chinese who viewed the ensuing crossfire with a mixture of cynicism and amusement.

Pundits say that after 53 years of failed nation-building by the BN, the Chinese community has decided that the two greatest evils in their country were now racism and corruption.

“This is why Soi Lek has failed to ignite support whether from the ordinary Chinese people or the business groups. Just go to any coffee shop and ask around, the first response is sandiwara. Then the more serious reply – you cannot fight racism with racism,” the MCA watcher said.

“So it looks like Soi Lek has failed and because of this he may be on the way down in MCA. If he wants to stay in charge, he has to pull the party out from BN, but for that to happen, then a leopard would really have to change its spots. May be that’s why Liow has already started sniffing around.”

The latest Merdeka opinion poll released earlier this week also showed only 9 percent of the Chinese electorate liked of supported Soi Lek.

Soi Lek going against constitution on Bumi equity issue, says Rais

JELEBU, Aug 20 — Information Communication and Culture Minister Datuk Seri Dr Rais Yatim has described the call by MCA president Datuk Seri Dr Chua Soi Lek for the gradual reduction of Bumiputera equity as running contrary to the constitution.

He said Article 153 of the Federal Constitution guaranteed the special position of the Malays and natives of Sabah and Sarawak and the legitimate interest of the other communities.

“When he called for the gradual reduction of the 30 per cent Bumiputera equity in all sectors of the economy, he was going against the constitution of Malaysia.

“Maybe he did not realise this but I would like to remind that Article 153 is not a simple provision; in fact, it cannot be amended by any party unless with the consent of the Conference of Rulers and subject to provisions in Article 159 of the Federal Constitution,” Rais (picture) told reporters after breaking fast at the Felda Pasoh 1 mosque near here yesterday evening.

He said that although Dr Chua might have tailored his remark to the political sentiment of his party, the Malays especially, could not accept it.

“If the call were to be implemented, firstly we would be going against the Federal Constitution and secondly, we would be undermining the position of the Malay Rulers, especially the Yang di-Pertuan Agong who is responsible for safeguarding these interests.

“This is not a mere practice but something that has been accepted by parties involved in the social contract in 1956-57 when the Reid Commission was formed, and when the Constitution of the Federation of Malaya, and later the Federal Constitution, was formulated,” he said.

Rais said he hoped that in future political leaders would refrain from saying things as they please, and should recognise things that had become pillars of the country.

These pillars, he said, should be accepted and not be changed based on current political sentiments.

“For instance, if Umno itself wants to amend Article 153, it won’t be able to do so, let alone Datuk Seri Chua Soi Lek, because there are layers of powers protecting it,” he said.

Rais said the constitution also provided safeguards for other communities.

If Dr Chua wanted to make a demand, he said, he could do so under this spirit of the constitution and not by denying the rights of the Malays and natives of Sabah and Sarawak.

On Dr Chua’s statement that the MCA would not hesitate to share common views with the DAP for the sake of the Chinese community, Rais said Dr Chua had shown that he no longer had respect for the vision of Barisan Nasional which is headed by the prime minister.

“The Malays should therefore unite in the face of this. If we are strong, we cannot be easily manipulated by others. We should unite and voice out to defend what is rightfully ours.

“If this is not done, then people like Datuk Seri Dr Chua will continue to undermine the basis of our struggle,” he said. — Bernama

Warming up for the Battle of the Ants

COMMENT Detractors of the Malaysian Chinese Association are fond of giving amusing and impolite interpretations of what the abbreviation MCA stands for. But those who still have faith in the party—especially in president Dr Chua Soi Lek’s ability to lead it—prefer to call it a Maddening Colony of Ants.

They feel that such a description gives the party a macho image that contrasts with the popular perception that it is a BN wimp or Umno’s errand boy.

Last weekend, Chua almost managed to give the party a sorely needed oomph with some words of defiance, both at the Malaysian Chinese Economic Congress and a briefing for the party’s divisional leaders.

At the congress, he called on the government to relax the 30 percent bumiputera equity requirement. At the briefing, he said MCA was “preparing for war” to win back Chinese voters.

Not even a week has passed, and already all those drumbeats are beginning to sound discordant. And accusations that this is all part of a BN sandiwara are gaining more credibility with each day.

To MCA members, many questions about the future of their 60-year-old organisation remain unanswered.

Chua’s belated outspokenness evokes the grim memory of 1986, when then president Tan Koon Swan paid the price of speaking openly on issues of vital concern to the Chinese community.

Tan had earlier defied Umno’s wishes by contesting against acting president Neo Yee Pan for the MCA leadership. As if that did not ruffle enough feathers, he continued to speak up with no holds barred. Eventually, he was imprisoned.

In the last few days, Chua has been receiving stern reminders from the Umno leadership that he should not share the opposition’s platform and undermine the BN coalition when fighting for his community’s rights.

In short, he should toe the mark and be subservient to Umno.

A wise more?

Is it wise for Chua to continue with his gamble? Can he eventually emerge as hero despite his tainted past? Is it worth it, knowing that Umno is always capable of finding a way to punish him? Is he so naive to think that his sex DVD cannot now be used against him just because he confessed? Balls caught in UMNO's snare .

To many, Chua’s display of defiance against Umno’s race card was a desperate move to regain confidence from the Chinese community.

But the message from Umno and its proxies is clear: MCA must stay in its place, where it must continue to play the subservient role of delivering Chinese votes and avoid touching on the privileges and rights of the Malays.

The public crossing of swords has not helped Chua or Umno leaders gain any additional respect, although MCA has gained some sympathy for having to work like a horse without the right to ask for fodder.

Chua was explicitly told that the removal of the bumiputera quota was the sole prerogative of the government, i.e. Umno.


Is it performing the role of a political concubine to ensure that the castle and corridors of powers in Putrajaya remain firmly with Umno?

The message to Chua and the public is clear: only Umno can call the shots. MCA, as the second most senior partner in the ruling coalition, is not even fit to play second fiddle when it comes to major decisions affecting the race equation.

MCA, like an ant colony, traditionally thrives best in rural and semi urban areas. But in recent decades, even these areas are no longer safe. In short, the next general election may well be a do-or-die affair.

Hence, the Aug 15 briefing was a deliberate attempt to stir the ants’ nest. MCA has to be in a state of preparedness for war. But this requires more than seeking public sympathy by making constant references to the party’s past sacrifices.

Battle plan

It requires action on many fronts. Efforts to maximise voter registration even among its own members, 15 percent of whom have not registered to vote, can be an arduous task, particularly because there are still areas where rivalry among grassroots leaders is intense.

Changing the old mindsets of veteran leaders so that they can competently engage in cyber warfare is also a great challenge. So is equipping electoral operation centres with the latest communication gadgets. And waging a propaganda war against the Pakatan Rakyat coalition requires trained spinners and cyber troopers.

Nevertheless, MCA has promised to spring a surprise on the opposition.

But perhaps the most pressing question of all is: do intelligent Malaysian voters really care?

The question is best answered with another question: Who is MCA fighting for?

MCA is claiming to fight for all races despite being a communal party.

But why does MCA need to fight for these rights if the BN regime—of which it is a part—is fair to all communities?

Is MCA in fact fighting for the survival of Umno by delivering the Chinese votes for BN? Is it performing the role of a political concubine to ensure that the castle and corridors of powers in Putrajaya remain firmly with Umno?

UPDATED In a move that is bound to compound ultimate owner MCA’s woes, its unit Star RFM has suspended two top executives from radio-station 988 after industry regulator MCMC complained one of its programs was threatening "national security" and "compromising race relations".

Already rejected by the Chinese community for consistently bowing to high-handed political pressure, the MCA's latest move at 988 is seen as part of a major media clampdown ahead of the general elections widely expected in the latter half of 2011.

It is also seen as another cop-out by the Chinese party to appease coalition boss Umno after president Chua Soi Lek stepped on toes including those of Deputy Prime Minister Muhyiddin Yassin over a proposal about the 30-percent Bumiputra equity target.

"What is happening at 988 is not an isolated incident. It is part of a trend which began a while ago. One of the first to be axed was a very popular political discussion on Astro's 301. Then there were similar moves at RTM and NTV7," Pantai Jerejak assemblyman Sim Tze Tsin told Malaysia Chronicle.

"And the worse thing is our civil rights are being ruthlessly played with. They are being sacrificed because Umno and BN have no confidence of being able to win against Pakatan Rakyat on a level playing field. From TV to opposition newspapers to radio, mark my words, the Internet will be next!"

In a statement issued late on Thursday, Star RFM s chairman Linda Ngiam said the firm was conducting internal investigations into events that led to a 988 radio host Jamaluddin Ibrahim being sacked on Thursday.

She also said the probe would cover how the matter was handled by the staff in charge of the station.

"I can confirm the Malaysian Communications and Multimedia Commission had issued a letter dated Aug 18 to 988, regarding certain contents aired over the radio station that it deemed to be offensive,” said Linda.

However, Linda failed to mention that chief executive officer Wong Lai Ngo and senior program manager Chen Jia Rong had also been suspended the same evening. According to reliable sources, both have been frozen pending the internal probe.

Purpose of MCA - is it to protect Chinese rights or to keep Chua in power

Jamaluddin is the son of a famous Malay freedom fighter from the colonial days, Shamsiah Fakeh. His Zhao Dian Shuo Ma or Say Hi to Malaysia show is very popular with the Chinese-speaking crowd, who enjoy the discussions on current issues and regular phone-in sessions. Jamaluddin was born in Beijing and speaks fluent Chinese. He is also a regular contributor to Chinese-language newspapers and magazines.

Since then two other deejays, who announced his removal on air on Thursday and commiserated with his plight, have also been removed.

News of Jamaluddin’s persecution and the government’s high-handed action has stirred a new groundswell of anger and frustration from Malaysians, disgusted at the way their rights have been constantly eroded by the BN government.

Prime Minister Najib Razak is perceived as being anxious to cling to power at all costs. Neither he nor his Umno colleagues have displayed any qualms about turning the country into a police state to check the advance of the political opposition.

“It is pitiful for the MCA to make scapegoats of the 988 staff. It also is clear that the new MCA top leadership under Chua Soi Lek has launched a purge and is now tightening its control over all the media owned by the party," Batu MP Tian Chua told Malaysia Chronicle.

"The thing is, is this what MCA members really want? Most of them are fans of the station and it is time they challenged him for abusing the purpose of what MCA was set up to be - to look after the rights of the Chinese community or to keep him ( the DVD actor ) and his son in power."
