PUTRAJAYA (Nov 24, 2009) : Deputy Prime Minister Tan Sri Muhyiddin Yassin is seeking the cooperation of all MCA leaders to refrain from making any statements because such statements will reflect continuing conflicts in the party. 
Muhyiddin, who is also the Barisan Nasional (BN) deputy chairman, said in the process of finding a formula for a settlement, it was better that the leaders did not make any statement.
"Once we have reached a consensus, only then do we issue a statement and maintain a good image. If under such circumstances, A says this, B says that, C says something else and D too says something else."
"To me, this will confuse the community, and the MCA members certainly want to see how we want to resolve the problem," he told reporters after chairing the 7th Meeting of the National Minerals Council, here today when asked to comment on the various views and statements made by MCA leaders on the party's internal crisis.
DPM now only knows he's dealing with a bunch of Brutus Monkeys ( new species ) only found in Malaysia . He also now realises he's been conned by them with their false pretenses and twisted stories . Hence the need to zip them up , since its these monkeys clattering all the while .
Liow: Fresh elections not needed for wings
PUTRAJAYA: Fresh party elections in MCA should only be applicable to the parent body, and not the Youth and Wanita wings.
Embattled party vice-president Datuk Seri Liow Tiong Lai said the fresh party polls were to settle disputes in the parent body, and had nothing to do with the other wings.
"There is no need for Wanita and Youth wings to have a new election."
Liow was commenting on news reports in Chinese dailies of mutterings in the grassroots to elect afresh leaders for the two wings, leaders of both who are incidentally his allies.
The Wanita head is Datin Paduka Chew Mei Fun while the Youth chief is Datuk Dr Wee Ka Siong.
Liow sidestepped the question of whether it was "undemocratic" if the wings did not have new polls as well.

LTL appears not to have leadership quality at all. His mind is wavering like the waves of the ocean. When the wind blow from the opposite direction as a wolve he doen't know how to sniff the air for scent not like the real wolf who read the contour of the land/surroundings and his prey. He should accepted OTK magnamous offer to return to the fold intead he cided otherwise. There is certainly otside movement which motivate/encourage him to act the way he did. Now that the baby wolves are learning some of the tricks on how to hunt for the prey he leads them on not knowing the contour of the land has altered. Will he be able to achieve the toppling of his prey as intended. It appears that he is fighting a losing battle. Not only CCM be subject to fresh poll and re-elections but the youth and wanita wings as well. So how could the wavering wolve says the baby wolves not invoved - they are part of the pack as is well known by the elephant and tiger media that frquently go to histheir rescue. To be vindictive for what they have done, don't say "No' to re-election. There is nothing more acceptable than having a fresh start. So how to sanction? moreover, i think currently no more diciplinary board, so technically no one is in charge to punish them.

If fresh election is held only for the parent body than the period of tenure for the officials will differ from the youth and wanita wings. This will cause management hiccups for the party. They will have to have different AGMs for the party elections, one for the parent body and another one for the youth and wanita wings. What about the CCMs and the CDs?
It is easy to just rumble any thing without thinking but have LTL thought of the consequences and implications? Does LTL know what does NATO means? No action talk only. Lock down the building and then send a team inside.
Each and every MCA members found attending that illegal assembly will be immediately have their MCA membership revoked.

My view: MCA as a political party does not control/manage Wisma MCA. The Wisma is managed by a Sendrian Berhad. This company is a commercial enterprise. So it may enter into any contract with any person/company --eg. rental of hall/seminar rooms etc.
Wong NZ that day mentioned that the Company had accepted their "booking" (of the Lee San Choon Hall)....I don't think it is wise for MCA leadership to block the use of the hall on 1128....

My view: I think this is not correct.
"Article 14.4 he is an ex-member whose membership has ceased through expulsion or resignation and has not obtained the prior written approval of the Central Committee."
This means a member may be EXPELLED from the party after certain procedures are complied with. Eg case is taken up by the Disciplinary Board, then under Articles 125 recommend to Presidential Council & endorsed by the CC...:
"Article 45.24 [CC] to take whatever disciplinary action it deems fit
against a member, Sub-Committee, Committee,
Branch, Division, State Liaison Committee any
organiser...."
Divisions have this power:
"Article 86.6 to recommend the expulsion, suspension and/or
any other action against a member within the
Division or the suspension, dissolution and/or any
other action against a Branch within the Division
to the Presidential Council;"
Branches also have power: Article 111.5 to recommend the expulsion, suspension and/or
any other action against a member within the
Branch to the Presidential Council.
CONCLUSION:
(a) Strict procedures need to be complied if the party wishes to expel "members";
(b) At this turbulent/choppy times, I think it is UNWISE to take any disciplinary action against any FGZs. Further, we don't even have a Disciplinary Board to begin with!
(c) Now we should concentrate on seriuos negotiations to settle opposing views on the re-election date. If every faction is willing to accept the GUP, that is the most IDEALlah....But I think the reality is the re-election is inevitable now.
(d) The opposingfactions must cease fire and comply the gag order. For our own survival!

My point of contention is that he cannot organise the illegal assembly-the Unconstitutional EGM because it is not sanctioned by the party. Any member who lodge a report pertaining to the misusing of the MCA as a political party is against the law.
They are organising an illegal assembly without any permission from MCA HQ thus it is an offence.

ReplyDeleteWith due respect, Article 14.1 refers to ex-member who is applying to become member. Whereas Article 9.3 is about member who is in benefit. Thus all members have to adhere to Article 9 and its sub Articles which includes Sub Article 9.3. to remain members. Those members who attend the illegal assembly at the national level should be dealt with using Article 9.3.
Article 86.6 deals with any indiscipline at the Divisional level.

Witness how the PDRM treated the oppositions --- they had legally booked a private hall for a ceramah, and the police came in and halang the ceramah from being held, inside that private hall !
Which means, if PDRM wants to, they HAVE THE RIGHT to halang that illegal assembly inside the Sam Choon Hall.

The MCA HQ -say Sec-Gen- may go to the hall to stop the 1128EGM, becoz CC had decided that it is uncontitutional....
Maybe the Sec-Gen can stop them from using party logos, flags, letterheads etc..
But what will happen during the intervention by the Sec-Gen? Don't you think that chairs may fly like flying carpets?
It is WISE if the party HQ/Sec-Gen etc DO NOT TAKE ANY ACTION. Just observe from far, and make records maybe....
Though there was rumour that about 1,200 delegates may attend on 1128 [bearing in mind that Ong brothers & gang are powerful to 'persuade' so many delegates to KL],it is likely that the EGM will be aborted for lack of 1/3 quorum (794/2380).
I suspect that, when the EGM is aborted due to that factor, some veteran lawyers may declare the EGM "postponed" for a week ( I will cite you the relevant Article in the MCA constitution later)....
This happened in the 1980s when Tan Koon Swan's faction called for an EGM to force Neo Yee Pan to retire....
Illegal Assembly is an offence?
Under the Society Act 1966, maybe an uncontitutional EGM is an offence.
But this is NOT for Police to interfere (my view). This uncontitutionality is for ROS to adjudicate....

MCA members who meet in the Wisma MCA's Lee San Choon Hall are not meeting in a public place as defined by the Police Act 1967.
So Pas members can meet/assemble in their party HQ in Melawati Gdn/Jln Kebun Bunga Shah Alam etc without any Police permit.
DAP members who hold seminars/talks/forum in Ball Room PJ Hilton for eg needs a Police permit because that Ballroom does not belong to them.
I will explain further when I find a copy of the Police Act 1867.

The Unconstitutional EGM is being organised by the lost souls without being sanctioned by the party. If any MCA member lodge a police report that they have misused the party's name and logo etc the police have to take action as it is a crime being unconstitutional as it involves a legally registered party ie MCA.
MCA HQ is advised to report the illegal or unconstitutional EGM to ROS otherwise MCA may have to bear the consequences.

My humble opinion is if there is something in MCA's constitution which disallow MCA's members (or anybody else for that matter) in misusing MCA's property, then MCA (or any MCA member) can and SHOULD file a police report in asking the police to STOP the abuse BEFORE it happens !!

ReplyDeleteOnly activities or assemblies sanctioned by the party ie MCA are allowed to use the MCA’s name, MCA’s logo or MCA’s emblem according to the Society Act 1966.
MCA HQ or any member can lodge a report with the police if they may harm the party (MCA) in any way or form.
As the 2nd EGM is not sanctioned by the party which has considered it Unconstitutional then the MCA HQ should lodge a complaint with ROS and the police to avoid any implications later on. Those found guilty by ROS normally will be barred from holding any office bearers in any society legally registered with ROS. The severity of the offence taken into consideration.
MCA itself could also initiate Disciplinary Action against the party concerned for holding and attending the Unconstitutional EGM. Refer to Sub Article 9.3 of the Party Constitution.
As said by Kedah Life Member the WISMA MCA is managed by a WISMA MCA Sendrian Berhad. This company is a commercial enterprise. So it may enter into any contract with any person/company --eg. rental of hall/seminar rooms etc.

(1) Where the issue is "contitutionality" ( say, an EGM) , I am told that Police won't interfere--because that is your internal problem.
(2) Only ROS is the appropriate authorities to deal with "contitutionality" issue. Actually, after the CC meeting where more than 2/3 ruled against the 1128 EGM, Sec-Gen should have written to inform the ROS about the matter and decision. Then it might be possible to request for ROS' letter/ruling to be used to STOP the 1128 uncontitutional EGM....Though I doubt it that the ROS will be so helpful/efficient in issueing the that letter....
(3) So that we won't be accused of "sabotaging" the EGM, suppressing the minority (nuts!), or oppressing the aggrieved members of the party...the MCA HQ should REFRAIN from doing anything. Just sit back and watch, and record on video....ROS is the authorities to receive our report/complaints later.
(4) Sec-Gen should also write officially to CPO/OCPD abouyt the 1128 uncontitutional EGM, so that FRU/PGA units can standby for any unruly situation....
(5) CONCLUSION: Barring any LUCRATIVE/HANDSOME bribe, I am confident that less than 1/3 of the 2380 delegates will attent on 1128. When this is the case, under Article 32 of our Constitution, the EGM shall be aborted for lack of quorum. STOP.

Extraordinary Meeting of the General Assembly so is not present within 30 minutes of the time scheduled for
the start of the Extraordinary Meeting of the General
Assembly so requisitioned and is not so present at all times
a quorum is required herein the Extraordinary Meeting of
the General Assembly so requisitioned shall be aborted but
the lack of quorum shall not invalidate any proceedings
carried out with a quorum.

ReplyDeleteReporting to Police is a way to show to the lost souls the seriousness and the negative impact of holding an Unconstitutional EGM. It may come handy when ROS starts investigating, otherwise MCA HQ may be blamed for ignorant if any untoward incident happen during the illegal assembly.
After the Unconstitutional EGM the party concerned has to inform the ROS about the outcome and I wonder how they are going to write the meeting minute.

The party HQ Administrator, under the directives of the Sec-Gen only can carry out such functions.
I am confident that they (HQ officials) had done what should be donelah!
Let's not to worry. Let the 1126 EGM be aborted by "miscarriage" --all because of the stupidity of its requisitionists....

When WNZ said EGM2 will turn into a briefing session if not enough people - there is a catch, don't you see. What he really means is to get more delegates to come in the guise of just briefing , i.e., to turn a serious meeeting into a non serious one just to get more to turn up.
