Joseph Goebbels (above) was Hitler's minister of propaganda. His lies cost the lives of six million Jews, and others, in Germany and Europe. Goebbels lied to the Germans especially, making them believe Jews were sub-human, so when the Nazi exterminated the Jews no one bothered to say it was wrong. The Malaysian Insider, like Malaysia Today and now Malaysiakini, is doing the same thing as what the Nazi propaganda machine did during Second World War, and this must stop at all costs, before "six more millions" will be exterminated!

ROS letter: Only Liow can't understand it
I refer to the Malaysiakini report Latest twist: 'ROS did not confirm Chua as No 2'.
In the above news report, sacked MCA Legal Director, Leong Tang Chong, a senior practicing lawyer, highlighted the issue of the Registrar of Society (ROS) not specifically mentioning that Chua Soi Lek is the deputy president of MCA.
What Leong is trying to do is nothing more than sensationalise an issue legally disposed by MCA central committee on Nov 3. Of late, because of marginalisation of their political influence, Liow Tiong Lai's faction has resorted to sensationalising practically everything to disrupt the 'Great Unity Plan'.
As your readers will possibly recall, on Oct 15 the CC meeting of MCA was very reluctant to fill the party's deputy president post. Members of the CC were not legally certain that there existed a vacancy but Leong proceed with his own interpretation of the party constitution and subsequently bulldozed through the appointment of Leow as deputy. After that motion, the pro-Liow faction proceed to grab power by insisting on the resignation of president Ong Tee Keat.
In order to facilitate the power grab on Oct 15, Leong invoked Article 174 to interpret MCA's party constitution according to his hidden agenda but in reality, the position of deputy president after the Oct 10 EGM was well protected by Article 35.
Article 35 specifically spells out that any motion to remove office-bearers must be supported by at least two-thirds of the delegates present and their voting in the general assembly. As such, there is no need to invoke Article 174. Leong has taken a very absurd view simply to support Liow's faction.
Also in the same meeting, Ong directed an EGM to be called for fresh elections but Liow said it this was against the party's constitution. Three weeks later, when Liow's faction petitioned for fresh elections, he turned around and said it was perfectly in tandem with the constitution.
What sort of professional we are looking at ? This is not professionalism any more, it is purely politics. Leong has helped out Liow thinking that Liow will soon become MCA president and reinstate him as chairperson of The Star newspaper.
However, Liow could not make it and Leong was later removed by Ong Tee Keat on Oct 17 soon after which he become a sore loser. Leong's action is more like a politician than a lawyer even though he claims to be neutral.
There nothing much to argue on the ROS' wording 'that the post of deputy president has never fallen vacant', meaning that the seat still belongs to Chua.
The MCA Disciplinary Board meeting (Aug 4), the presidential council meeting (Aug 26) and the CC meeting (Sept 19) all did not remove Chua. On the contrary, when the first motion was adopted at the Oct 10 EGM, Chua has returned to his full status as a member. Batu Pahat divisional chairman and MCA central delegate as well as deputy president.
The third motion to block his way to return as deputy president failed to do so because Article 35 requires a two-third majority to remove any office-bearer.
It is all that simple but sensing that the central delegates are getting tired and bored, Liow's faction must create some sensational issues to attract attention for the sake of EGM on Nov 28. Everybody, lawyers and non-lawyers alike, can easily understand the wording of the ROS' letter Nov 3.
Only Liow chooses not to understand it. The ROS has written a well-worded and straightforward letter. It is only Leong's wishful thinking that Liow could still make it to the presidency.
Wake up, the people are already fed up with Liow's actions so what has he got to lose if he supports the GUP? Being a minister and vice-president is still not sufficient for him? Only the seat of the presidency can fullfill his ambitions?
What about the 99.9% of party members who do not stand to gain anything from the party? Going by Liow's mode of thinking, they had better quit the party en-bloc.

REASONS WHY THE 2ND EGM TO BE HELD ON 28TH NOVEMBER 2009 IS UNCONSTITUTIONAL.
ReplyDeleteMCA is registered according to the SOCIETY ACT 1966. Any action taken by party's members is deemed UNCONSTITUTIONAL if it contravenes with the party’s constitution.
1. ON 29th Oct the Party Headquarters received a requisition for an EGM by 16 Central Committee Members pursuant with Article 30.2 of the Party Constitution. The proposed motion was rejected by the Sec. Gen of the Party on the same day as the proposed resolutions are found to be unconstitutional ( Refer to Article 35, Article 41 and Article 167 ). Thus the requisition for the said EGM was not executed on the 29th October 2009. They only requested or requisitioned for the said EGM.
On 5th November 2009 the requisitionists represented by Wong Nai Chee, Datuk Wee Jeck Seng and Dato Liew Yuen Keong sent out the notice for the EGM to be held on 28th November 2009. Thus 5th November 2009 is the date when the requisition for the said EGM is deemed to be executed.
The point for contention here is the number of requisitionists which had already dwindled to only 12 incumbent CCMs as four appointed CCMs who were part of the requisitionists whose tenure as CCMs had been terminated by the President(Article 166) on 3rd November 2009. Therefore the requisition for the said EGM does not conform with Article 30.2 of the Party Constitution. The day when they executed the requisition on the 5th November 2009, the number of requisitionists fell short of the 1/3 required. This has rendered the 2nd EGM called UNCONSTITUTIONAL.
2. 1st Resolution: That fresh elections be held to elect a new CENTRAL Committee for the Malaysian Chinese Association (MCA) within thirty days form the date of adoption of this resolution.
2.1. Article 41 states that if two-thirds or more of the elected CC members shall at any time cease to be members of the Central Committee, the remaining members shall within three days elect one of themselves to convene at the shortest possible time an EGM to elect a new central committee.
2.2. Article 167 provides that party elections will be held once every three (3) years.
Thus the 1st Resolution does not conform with the Party Constitution. An EGM with resolution contravening the Party Constitution is deemed UNCONSTITUTIONAL.
3. 2nd Resolution: That all appointments, terminations or pledges made afer the 10th October 2009 EGM by YB Dato’ Seri Ong Tee Keat in this capacity as President of the MCA be nullified.
3.1. The 2nd Resolution runs counter to the powers conferred to the President to appoint or to terminate any appointee pursuant to the Party Constitution particularly Articles 38.11 and 166 of the Party Constitution.
Thus the 2nd Resolution does not conform with the Party Constitution which has again rendered the said EGM UNCONSTITUTIONAL
VERDICT: The 2nd EGM proposed is UNCONSTITUTIONAL and should be called off as it may invite legal implications which may be detrimental to the party unity.
GUP is inclusive aims to unite, heal and serve the nation and the Chinese Community in particular thus I still see no reasons to reject it.

Why did this Naihmah! Ong Kah Chuang on one hand asked to stop fighting because it may end with ROS declaring MCA illegal and then on the next breath shouting for 2nd EGM. Why is this contradiction? Why dont he stopped making noise. No else is making noise except he and the 2 male Brutus and one female Britus.

ReplyDeleteThis Ong Ka Chuan is one of the black hand behind this whole thing wanting to become a back door president . His first step is to be appointed back to his SG post which Liow had promised him and also a minister's post .
ReplyDeleteHe has forgotten that because of him and his brother , MCA nearly got wiped out , but their fortunes were turned upside down by fate , they are not fated to be in the driver's seat and will never be .
The BM Division under the leadership of Lau Chiek Tuan set up 10 Phantom Branches prior to the Party election sometime in 2004 to be in time for the 2005 party elections and until now is still there . That was the reason the BM division people brought the party to court resulting in the constitution amendment and approved by ROS in 2007 . Subsequently they all left en bloc . Today the Dep speaker of Penang is one of the ex mca members who left and join PKR . All because of Ka Chuan .
We also lost Perak because of Ka Chuan . Immediately after the 308 , BN had 28 ADUNs compared to PR who had 31 ADUNs . If BN had won additional 2 , the score will be 30 for BN and 29 for PR . BN would have formed the state govt without all those mess in Perak today with a thin majority of one .
Why put the blame on Ka Chuan ?
He was or is ? the state Chairman of Perak at that time . MCA contested 16 state seats and only won one , lost 15 . Why we lost ? because he changed the candidates at the last minute when the proposed were all removed and replaced with his machai(s) with the approval of his brother . The divisions revolted and refuse to campaign and voted for the opposition to make sure they lose the election .
However we won three Parliamentary seats in Perak , the brother put OKC in a safe seat in Tanjong Malim which is traditionally an MCA safe seat . We won the other two Lumut (Kong CH ) and Batu Gajah ( Lee Chee Leong )
Normally we would win at least two state seats for every parliamentary seats as there are three state seats for every parliament seat . On most occasions , people would vote BN for state and opposition for parliament as they want a voice in parliament and development for state ,this was not the case .
It is very clear the people REJECTED OKC's change of candidates and its also very CLEAR they REJECTED the ONG Brothers Sdn Bhd .
They voted Parliament for MCA and voted OUT OKC's choice candidates .
Maybe I'll write an article on this .
Since OKC is very smart in creating PHANTOM BRANCHES for MCA during his reign as GS . And now he sided the Brutus Gang for the 2nd EGM and threathening MCA would be de-registered if he was not accepted inside the latest CC as 2nd post. One day or now we will call him as PHANTOM PRESIDENT of MCA.

With due respect, Datuk Seri LTL you do not have to explain anything to the Prime Minister. Walk your talk. You have been harping about MCA and DEMOCRACY. Being the leader of the MINORITY group of about 12CCMs don't you think thay it is only appropriate of you to cooperate with the President and the Chairman of GUP Datuk Seri CSL to make GUP successful. You must remember that GUP has been sanctioned in the CC meeting which you were part and parcel of the decision made. Following the consensus of any decision made in a meeting is DEMOCRACY.
Please study the reasons for the resolutions requesting the 2nd EGM, the manner the requisition had been executed and the legality of it. All pointing to irregularities thus the 2nd EGM called is UNCONSTITUTIONALLY.
MCA does not face any leadership problem. It has been artificially ballooned as if the party is in a chaotic situation. If the 12CCMs toe the line and practise DEMOCRACY, is there any problem?
Ong KC is already a failure in taking care of Perak. It's time now to let others lead the party. Your short cut method doesn't work and MCA doesn't need failure to lead them to Hollan.

(1) As AH PIU argued above, MT is "fair" in PUBLISHING MCA stories from all factions. Exposures made by the ghostwriter, " I LOVE MALAYSIA" for eg., only appeared in MT and not elsewhere....
(2) Malaysiakini.Com: Though this portal supports only the opposition, its teams gave MCA especially OTK a good,positive coverage. In particular the exclusive interviews in Chinese recently. When almost 90% of the Chinese language newspapers are anti-OTK, we certainly need Malaysiakini.Com (Chinese section especially) to disseminate our views....
(3) TheMalaysianInsider.Com: Though it was pro-Chua Soi Lek last time, and now it appears to give more space for Liow's gang, we must admit that the portal also gave OTK "fair coverage".
Now we were attacked by the spins in Utusan and NST - Friday & Saturday respectively.
We can describe our OTK's situation is truly "surrounded from all 10 directions" ( 十面埋伏 ).
So I humbly submit/suggest that we should NOT further antagonise (对抗)the mass media including those which anti-OTK.
We only need to correct their spins by writing/sending our 'spins'....I still believe they are obliged to publish our postings....
That explains why I stated b4 and am stating now again--PLEASE FOCUS OUR ATTACK ON THE SENIOR SNAKES & ARGUE ON THE CORE ISSUES.
Mass media are still helpful to us.

These portals have lately only realized that the public are no longer fooled by their spins and half truths . Only recently have they started to write more realistically and factually . Somehow or other something must have happened lately .

Don't you think the police is so stupid as to not be able to locate him ? or have they turned a blind eye to him on the sedition and defamation case ? Do you think I love Malaysia would have been able to post articles there a few months ago ?
I have most of the articles which to me is pure bullshitt since 2004 . Ya downloaded most for them .
Like I told MCA watcher , lets concentrate on the party first while keeping an eye for these spins which I have posted here if you care to read back some of the articles in October or September .
We should keep them on their toes because they know we are watching them and their article .
