Their resignation is on condition , ie valid only when 21 CCs resign to force a fresh election .
If the two thirds is NOT met , then their resignation becomes invalid ie , that they have never resigned from the CC .

by letter submitted to the Secretary-General giving his
reasons. The Central Committee shall consider his
resignation at its meeting next after the submission of the
letter of resignation. In the event of any of the elected
members of the Central Committee ceasing to hold office
for whatsoever reason the Central Committee may appoint
another to fill the vacancy until the General Assembly in
which Party elections are held.

If DPM Muhyiddin asks these 12 running dogs to eat shit , they will quickly go and eat shit !

A letter from YB who resigned before election is treated invalid by the court. A resignation only valid after seeking other persons to resign to make its formality seems never heard. Legal advise should be seek before for discussion, as chinese say WATER BRING WITH MUD. Really cannot understand MCA leaders how to be a politician ?

ReplyDeleteThis means that the CC can "play dirty" and consider their resignations as resignations per se [ simply put the date by rubber stamp ], and go ahead to fill up the vacancies left by the 12 (or 13?).
Luckily, I believe and maintain, the President & Deputy President are gentlemen....But there is nothing to stop both of them from "playing dirty" --actually it is playing by the rule/law/party constitution...FOR, THE CC DECISION IS FINAL AND UNCHALLENGABLE IN THE COURT!

Our Sec-Gen Senator Wong said (in China Press Online that the CC would study if those 'resignation' letters are valid....
ReplyDeleteSo many conditions are attached to the said letters (Star Online ) :
(a) The resignation letters from the 13 CC members are undated.
(b)The sec-gen will only put in the date when 21 CC members have resigned.
(c) the resignation was only for fresh polls to be called.
(d) If no 21 CC members were to resign by Dec 25, which is the deadline, then the resignation from the 13 would become invalid.
I suggest the CC in its next meeting EXCLUDE all these 13 pending the study by the CC....Let them shiver a bit lah....
The CC is fully empowered to determine that the said letters, after dated by the Sec-Gen, are valid 'resignation letters', and its decision "shall be final and conclusive and not
subject to question by or in any court of law." (Article 174)
And to kick them out of the MCA leadership, they should be reminded that the CC only needs the attendance/quorum of 12 members (out of the balance 17 elected members):Article 44.
Article 44. The presence at all times of at least twelve (12) members of
the Central Committee shall form a quorum for a meeting
of the Central Committee.
It is so easy nowadays to kill comrades/FGZs politically. LUCKILY, as Sdra Hei Bai Dao put it above, OTK-CSL team is no so mean/blakc-hearted lah....

ReplyDeleteJudging from OTK's character, I dare say he will not bow to external pressures even if it means losing his position unlike the LTL Faction. If OTK is that timid, he would not dig into the PKFZ scandal knowing full well it is a time-bomb. You may say he has bad judgement, stubborn and rash. But at least he as MCA President portrays strength of steadfulness and courage in facing external onslaughts. We need a strong MCA leader, not a spineless one relying on outside forces.
